It's really unfair that the Federal government is kneecapping licensed dealers, but private sellers our there on Craigslist are selling their semi-automatic handguns to whatever unmedicated hobo can cobble together a couple of hundred bucks.

How is that "shall not be infringed"?

Depends on the state. In some places, private gun transactions are also subject to background checks. But it's the state that conducts the checks, so it's really a non-issue here.

Besides, the constitution says "keep and bear arms." It doesn't say a damned thing about "buying" or "selling" them. So, you're free to keep and bear the ones you have.

/Yeah, I know that last argument isn't going anywhere.

The state wanted to have a hand in background checks, but the State Police were delaying for two or more weeks. FFLs, by federal law, are permitted to complete the sale if no response to deny or delay is received after 5 days. So, FFLs were continuing the sales legally under federal law because the State Police were claiming to be overwhelmed and unable to process background checks in a timely fashion.

What made it more (or less) onerous is that the state was pissed, and the FFLs in most cases had received a federal "proceed" on the NICS check, so it's not like they were selling to people that didn't pass.

However, the law is the law, and some response is required within 5 days, whether it's delay, deny, or proceed. Nothing in 5 days, you can legally proceed.

As I understand the situation, Maryland's own law allows a firearm to be released if the police fail to return a response for a background check within seven days. Police were upset that some firearm retailers were in fact releasing firearms after the seven-day wait, rather than waiting up to one-hundred days for the police to return a background check result. They also instructed firearm retailers not to make use of the NICS system on their own (though I assume that the police check procedure involves a NICS check, to remain federally compliant).

D. No NICS Response within Three Business Days
If the NICS Section is unable to reach a transfer decision after three business days have elapsed, the FFL must note no resolution was provided within three business days on line 21d of the ATF Form 4473. It is then within the FFL's discretion whether or not to transfer the firearm.
