tillerman35: There were plenty dickhead-of-the-year awards to hand out in that case.  The owner of the Oatmeal was as bad as the dickhead lawyer in some ways.  He was certainly enjoying the power trip of riding the controversy, even though he was the initial injured party.  The whole bear thing was major asshattery.  And the fans who participated in the internet smackdown were just as bad.  None of them had any standing in the case, yet they felt some personal need to kick a guy while he was down?  There was no justification for their behavior, other than to enjoy the glee of participating in administering punishment.

This incident brought out the worst in a lot of people.  NOBODY, from the fans on up to the two main players, has anything to be proud of here.


The Oatmeal did not start the fight. The Oatmeal was the victim and did the right thing when confronted with a bully. He fought back and refused to let this legal troll walk all over him. Was it over the top? Yes. So what if it was? He was facing a bully who was threatening to use the legal system to ruin his life. Why shouldn't he call attention to it in the biggest way possible? Why shouldn't he reveal that lawyer for the troll that he is? He had every right to react the way he did. And he raised 200K for charity.

But he drew a mean picture and hurt that lawyer's feelings, you say. So? That lawyer was extorting him, or trying to. This is no different than a patent troll, and the way you fight these people is not to do so quietly, it's to make as much noise as possible so that everyone sees, so that everyone knows how to fight back. (Our own Drew Curtis knows a thing or two about that.)

Now, some of The Oatmeal's defenders did cross the line. Some of them were horrible, and I won't defend them. But The Oatmeal never urged people to take direct action against this lawyer. The only action The Oatmeal urged was to donate money to charity. Was he an ass about it? Probably, but again, he was the victim and acted out of defense. I would say he needed to be an ass in order to effective wage war against this unjust attack.

So, no, both sides are not the same. The lawyer was the worst person in this, and at worst, The Oatmeal may have hurt the feelings of the lawyer extorting money from him and made him look bad. I don't feel any pity for people who try to bully and then get called out on it.

He only admitted it after losing case after case, and now owing a bunch of money due to the backfiring of his attempts to use the legal system to intimidate and extort anyone who criticized him. On top of that, we had a link the other day about this with a lot more details and quotes from him about this kerfuffle. if you read it he basically still tries to blame everyone else in the world for his own actions, and pretends to be the victim in all of this. And terribly mangles buddhist philosophy to try and present himself as some kind of suffering, wronged party along the way.

I don't think he's really as contrite at all as TFA might lead you to believe. I think he knows now what he did wasn't a good idea from a practical standpoint... but I don't think he really has any understanding as to why, or any grasp of in what ways he was in the wrong.

Oh god this guy again. His wife's website is some of the most concentrated derp I've ever had the pleasure of reading. It's truly awe inspiring, and unfortunately, down. Happily I found this tidbit on another site.

I made the son of a famous CIA family a laughing-stock among other CIA. What the fark happened to [columnist] Kathleen Parker after I hit her [with a digitally altered pornographic photo]? Another laughter-fest among her friends? She runs with a cruel crowd, like the Inman gang. They wouldn't hesitate at doing a female sacrifice just for fun, because the opportunity presented itself.
I'm working on taking down Carl Jung and the rest of the Nazis right now. I've got lots of ammunition pointed in their direction. They might be getting a little nervous about having their BIG SECRET come out, which Houston Stewart Chamberlain so foolishly gave me. It's not allowed to be spoken, only read. But people can't help but crow! I heard that Gyatrul Rinpoche told all my fellow Buddhists that I was like a general, leading an army. That's pretty admiring. But I really don't think that I deserve it. Can I send it back to him?

I kinda felt the same way but wasn't sure if I was missing something. I haven't been following this thing too closely (this is the first article on the matter that I've done more than skim), so I don't know the blow-by-blow, but it makes it sound like Oatmeal guy just decided to blast the lawyer ad hominem from out of nowhere. Seemed like, at least at first*, the lawyer was just doing his job, being a lawyer? Legally representing his client? That doesn't imply that he personally approves of or endorses his client's decisions or motives, if I understand correctly. Sure, if a lawyer has a huge problem with his client that will constantly distract him from providing the best representation possible, he could turn the case down, but I doubt this guy had that much of an emotional investment in either The Oatmeal or FunnyJunk, right?

* It did sound (from this article at least) like it got a little hairier later, and the lawyer made a grudge match out of it, but if I have the timeline straight in my head, that came after he had been personally attacked for representing his client. So while he could have been "the bigger man" and blown it off, his response sounds at least partially justified.

His clients were stealing from The Oatmeal, so The Oatmeal called them out on it. Carreon then tried to extort money from The Oatmeal (supposedly without his clients knowledge) for daring to call a thief a thief. He wasn't just doing his job, he was trying to use the legal system to commit extortion. The Oatmeal might have been a bit dickish, but at no point was he wrong for defending himself.
