MFAWG: 7 am? Hell yes!!

Double the legal limit at 7am, crashed into a tree on a practice day 2 days before they face the Colts.

Good thing Harbaugh is so intent on running a clean operation over there.

I hope he punched the tree with his fist for being in the way and didnt just slap it.

7am implies he tried to sleep it off and failed.

Northern California, 2nd offense, suggests that he's going to be exiled from the Bay Area.

Still being at double the legal limit after trying to sleep it off is impressive. For a guy his size, he must've blown through a serious amount of booze last night.

2nd offense legal limit is 0.01. Were they using that or the normal 0.07 limit?

Possession of marijuana, as well.

Not that it matters legally in CA, but that may actually be more frowned upon by the NFL.

For a split second I thought, What the fark is he doing drinking so early in the farkin' morning?!!  Then I realized he probably got wasted the previous night and hadn't sobered up yet.

Either way, he's a dumbass.

Does the league acknowledge that?  I know workplaces generally can fire you for a drug test, whether or not you have a prescription.

No, they've made clear that weed is still prohibited by league rules.

That's the point. He spouted off about running a clean team after Irvin's suspension, then they traded for a guy who tested positive for "adderall" and have had 5 DUIs in the last couple years. Not to mention Aldon shooting a couple people.

Yep.  No one claims the Seahawks are angels; it's just that it's time for Harbaugh to drop the holier-than-thou act.

Man....Aldon is a kid in need of some help.  This time it was just a tree, but next time it may be a person he plows into.  His story has only two possible endings, one is jail, the other is death.  I hope the team and his circle gets him the help he needs before he gets there.  He should probably be inactive vs Indy, but its hard to sit one of the best players in the league, especially when the D-line is already dealing with a lot of injuries.

Per reports, he is practicing today. Though that may be a form of punishment. Hope he has a bucket nearby.

It's so easy to do the right thing, unless doing the right thing harms your ability to win football games.  If it had been a scrub, then fark him -- in fact, let Ahmad Brooks smack him upside the head with a bottle, then pressure him not to press charges.

Doesn't matter in the eyes of the NFL.

They came out with a prompt and clear message after Washington and Colorado legalized it.

I had no idea that a couple of Seahawks blowing a test suddenly meant it was ok for SF to have a team full of cheaters and drunks, and for Harbaugh to publicly mock the Seahawks while he's signing dirty players.

Oh, wait...

It's not so much about the team itself, even though Lynch walking across the goal line twice on Sunday night and at another game grabbing his jock are classless (but it's hard to overlook the enormous amount of talent on that team).

It's more about some of the Seahawk "fans" and their incessant whining after they lost in the Super Bowl.

And I'm not a 49ers fan either, can't stand Harbaugh.

netweavr: Aldon Smith reportedly will be suspended 14 months after Lynch's punishment begins...

Some slight differences between the two incidents, but not a bad point.

Lynch's alleged DUI didn't involve any kind of accident, the officer's dashcam was off so there's no evidence of a failed sobriety test, there are no other charges of any kind, it didn't not occur during the season, and it especially did not occur just a few hours before practice.

True, granted the NFL will probably ignore the DUI entirely and suspend Aldon 6 games for legally possessing medicinal marijuana.

To be clear, I'm not saying Lynch should avoid suspension or anything like that.

It just seems to me that there should be some team discipline for Smith considering the idiotic circumstances of his DUI. One has to assume that his plan was to show up to practice still legally drunk 2 days before facing the Colts - Boom suspended.

But Harbaugh has decided that somehow he should have no hand in how this is handled. Fine by me, these guys are grown men blah blah blah. But if you're going to passively sit by while guys on your team are doing stupid shiat like driving drunk (5 in the last couple years), getting stabbed at parties at which they SHOOT 2 PEOPLE, getting popped for "Adderall", etc. you need to STFU about being "above reproach" when it comes to other teams' problems.

I would assume there's some sort of internal HR process that the team has. It is probably confidential for legal reasons and cannot execute within a single day. So when Harbaugh gets asked if Aldon Smith is playing, the answer is "yes" because he has no grounds to suspend him prior to the HR process completing. I'd hope that when the HR process concludes, the ordeal is handled accordingly (e.g. assuming we're being told the truth I'd expect some disciplinary action).

Granted, I may be giving the 49ers too much credit in terms of organization and process.

/ I'm also assuming HR gets the weekends off.

IIRC, they suspended the last guy who got popped for a game before any NFL discipline came down. That's the excuse Harbaugh gave today - that the NFL handles these matters and his hands are tied. I have a hard tim believing that the head coach has no say in who plays on Sunday.

There's a difference between sitting people for no reason and sitting them for any reason. I'd speculate Harbaugh can sit people for no reason, but not for this reason. Not until an after an internal investigation is completed. Does that make sense?

Also, I have little faith in NFL discipline in general.

Fair enough. I see what you're saying. It's likely that he waited until later in the day to even speak with Smith. I know that's what I'd do in his position. First of all, because Smith might still be a little drunk, secondly because you don't want it to blow up on you.

Either way, it seems pretty hypocritical to start throwing stones from the porch of your glass house.
