I've always wondered how the Daily Fail gets away with what they do, given how tough libel laws are in the UK.

I guess they're usually careful to keep the real bullshiat aimed at people who can't sue them.  "ILLEGAL PAKI IMMIGRANTS MAKE 10K A MONTH ON DOLE" type stuff.

The thing is that our libel laws are not that tough, it's just the OMG FREE SPEECH derp that makes them look tougher than they are. You can repeat accusations about people as long as you say they are accusations, you can print things as long as you made a good effort to check the facts (fair comment defence), or you can print them if they are true. The British libel laws are roughly the same as they are written in America, it's just we didn't have a judge decide that libel must also show premeditated malice.

What i think people are confusing libel with are privacy laws and contempt of court. If you want to publish private details about someone you must show its in the public interest to publish or you will have to pay damages (so exposing a family values politician is picking up rent boys is fine, showing private video of a politician having sex with his wife is a private matter that isn't allowed). The courts have ruled that a person's right to a fair trial is equal to some ones freedom of speech so reporting and statements relating to a criminal case must stick to the facts (so no perp walk etc) until after the court case is finished. The Daily Fail did have to pay damages for libel and contempt of court recently for calling an innocent man a "Perverted Murderer" on the front page with a picture.

I remember, years ago, there was a TV commercial about STD awareness, and the camera panned thru a crowded city, stopping and slo-mo-ing in on one individual as she turned her head... It implied, they were talking about her... but in reality, she was just some random person not even aware they were shooting a commerical... She sued for big time bucks.

It's also classic false light invasion of privacy. The example my prof used was a public photo of someone strolling through the park being published with an unrelated article about rampant drug use and sex offenders who hang out in that park. Publishing a model's photo in an unrelated article about HIV+ porn stars would seem to be quite similar.

We did something like this a few weeks ago to a coworker. We love her to death and she was emailing out some of the proofs of her engagment pics they were in B&W and a few of us degenerates around the office turned them into PSA's.
