It seems like "sorry we don't have the heart of the guy that died 10 years ago" would make much more sense and probably wouldn't be an issue. However, "Yeah, we have that dude's heart and we're keeping it all to ourselves. Suck it", makes absolutely no sense at all.

I don't see why they didn't throw everything back into the cavity before they stitched the guy up. The only autopsy I've seen (one is enough) they sliced up some key organs like a tomato to look through the sections for visible abnormalities like clots. I'm sure each facility has it's own policy for managing medical waste, but who keeps it for ten ears? I'm obviously not a doctor.

Well considering they were going to sue the hospital if the painkillers were prescribed incorrectly, it might have been a doctor. Maybe a friend of the doctor who prescribed the drugs in the first place.

1. If they have it, they are total dicks for hanging onto it and not giving a pickled useless organ back to the widow.
2. If they lost it, they are total dicks for not admitting they lost a pickled useless organ, sucking up what would have been a minor insurance hit a decade ago, and moving on.
3. If there is some third reason, they are total dicks for not explaining THAT ten years ago, and letting this poor woman move on with her life.

Really, there is nothing here that doesn't make the hospital and their legal department look like complete and total dicks.

It could have also been part of the fraud.  TFA states that the hospital "fraudulently got Linda Carswell's permission for an autopsy she found to be incomplete."  When my wife passed away, they requested permission to use her organs.  I have no idea why I felt (and still feel the way I do) but I declined, with the exception of her brain, which might have been helpful (she had some severe psychiatric disorders, but still earned a Ph.D. in statistics and several other degrees along the way).  If they tricked her or outright lied to get the heart, that could have something to do with it.

Parts they keep, they tend to preserve and keep for a long time.  I don't know why... could be for teaching, for later study, who knows?  So it's a real possibility they still have it.

There was a scandal here back in the 90s where a bunch of parents found out their dead children's organs had been kept by a hospital for study. I think most were kept in jars for students to look at. The parents had either been tricked into signing consent forms or even, in some cases, had had their signatures faked, and had no idea parts of their kids had stayed unburied. I remember one woman describing a lawyer showing her the form she'd signed, only to find whoever had signed it had spelled her name wrong.The only good thing about the case is, so far as I know, everyone got the organs back without any further issues.

Have you met any lawyer, ever, in real life? They are taught to be aggressive dickbags who assume anything they can argue you into or otherwise get away with is legal.

Sadly I would believe anything anyone wrote or said that besmirches or impugns the reputation of any person or institution that has anything to do with (even in a peripheral sense) human health.

I have seen and/or been witness to, ineptness, malice, stupidity, greed, ignorance, misconduct (and a lack of accountability that makes the forgoing laundry list of problems possible) on a scale that would make anyone rethink having a mole removed.

Lawyers (and I have met and worked with a great many of them) are responding to the need of the wronged.  Whether it's a traffic violation or death on the operating table.  It is lawyers that speak for the wronged and in this case, hold the Health Community to their professed standards.

I am not lying when I write that the most horrifying and egregious examples of misconduct, malpractice and murder by health system never make it into the newspaper.  That's because of a Non-Disclosure agreement so the institution or self-professed "doctor's" image and reputation are not damaged.  Millions of millions of dollars change hands quietly, keeping you in the dark and thinking that you're safe in the hands of the medical profession.
