That does seem odd. There are other professions where workers essentially live off tips (e.g., waiting tables), but don't have to pay the owner for work. I don't see how this is different.

Fines that are "rarely enforced" also seem highly troublesome, because it can imply selective enforcement against those who have angered the owner. The owner could only allow someone to work terrible shifts, force them to pay for the opportunity, and fine them if they call in sick or get someone else to cover for them. The article didn't give a causal chain like that, but it did list all those penalties.

The business model is much more akin to a professional (say a hair stylist) renting work space.  That being said, it sounds like the crux of the case is that the house wants to treat them as employees when convenient and contractors when convenient.

As far as rarely enforced fines, I wonder if there are any things that the contractors do to curry favor and get favorable treatment.
