What are the chances she avoided going to the doctors for months, allowing the infection to spread until it was too late to do anything? Then she goes in to the doctor's, they do all the procedures/surgeries/etc, but it was too late.

2 things, one I always wear steel toe shoes and a hard hat going into the Wart.

The other is I bet and or hope they sued the Hospital, Doctor, Ambulance Drivers, Drivers Kids, the people who didn't pull over fast enough, the cops who didn't direct traffic, the homeless guy out front of the ER when he peed on the sidewalk and the stretcher went down dropping here again.  (please see safety should have used for Ambulance drive).

/Oh what the hell, everyone put on the bubblepack on everything then sue the world (not me, I'm poor, but sue everyone else).

Walmart bags are about as bad as they get. Just bought something there the other day, and sure enough... a bag with two pasta jars and two cans split open as I was pulling it out of the cart to load it into the car.

At least it didn't happen when I was moving it into the car.

Their bags split very easily. If I had to guess, it's because they are too thin and made using biodegradable plastics (i.e. plastics combined with cornstarch).

Best bags:Microcenter. I save these bags - nice and sturdy, last forever. Very good for re-use.

Not necessarily. Sounds like she got osteomyelitis, which is EXTREMELY difficult to treat and not very preventable in situations like this. If you get osteo, they usually end up having to debride the area and (if possible) amputate any bone that's infected. If they don't get it all, the osteo will come back. It can easily cause sepsis and since you can't really treat the source of the infection very well, it's extremely difficult to control.

OOOOOO good case.  I would love to have this one.

First, I've dropped a can of coke on my toe.  Hurt like hell.  Didn't know whether or not I had broken it until the next day.  Just another shiatty part of getting old.

Second, the issues of this case are comparative negligence (how long did she wait to go to the doctor, and was that reasonable?) and foreseeability.  If it was foreseeable that this could happen from their negligence (they clearly were negligent according to the law by either providing a defective bag or overloading a non-defective bag) then they pay.

The Fates had probably already cut her thread but screwed up on the car that was supposed to run her down in the car park and send her to the ER in critical condition. Rather than mess around with a whole heap of other threads that are all woven into the immediate future they needed a way to bump her off without any extra involvement but still involving the ER crew, so they mashed her foot and sent her to the ER doomed. Limiting changes to some minor urgent adjustments to the threads of the various hospital staff and her husband and kicking major changes down the road to where they can fix things without unpicking already woven threads.
