I would argue the police chief is a public figure and as such, the action should be considered free speech.  If I buy a domain name like "obamalovesitupthebutt.com" and linked it to relevant porn, I think that would be protected speech, so shouldn't this?

I'm guessing that they're referring to this law, but I don't see how the felony charge will stick unless they prove that the website was registered using false information AND the defendant committed a felony offense. This seems like a simple case of libel that should be settled in a civil suit.

I also think this law was originally crafted in 2004 as a gift by Rep Lamar Smith to the recording and movie industry. It's a way to pile charges on file sharers after the commit the "felony" of downloading the latest Adam Sandler movie.

But officers can tase grandmas or bean bag men sitting down as much as they like with impunity.

Haven't really been gone a while, no.  I was more trying to point out that, depending on when subby first started coming to the site, that he probably did find porn here (if he started coming here sometime 9 or 10 years ago when the posts were all over the front page.)

I'd love to know just what Federal charges he's charged with. By a Federal prosecutor. They tend to not take cases that lack merit, but this sure sounds like one.

There's got to be some more to this, or the reporter is confused, or both.

Funny thing is, the public defender doesn't always require a credit check of your net cash worth to provide services. Other places won't give you jackshiat if you are shown to have money(cash, house, car) to defend yourself, even if you go broke during it.
Occasionally a police officer(along with the secret assistance of his department) will use an 'obstruction of justice' method of the department waffling on whether to provide department money/lawyer to defend their criminal acting officer.
Even though the officer makes 70 grand a year, he can delay the case from getting to court(with perverted assistance from the easy going Judge) by stating about defense representation, along with funding issues, to delay the case for a year at times.

/The legal system is a mess and is good or bad to you, depending on knowing the tricks of the system.

Years ago some douche got prison time because he had registered a common misspelling of Disney and used it to redirect to porn sites (he was getting paid for referrals).  While I don't have a problem with porn, I do have a problem with this.  I was glad to hear he got prison.

If someone put up a website with www.doesstoppermobileloveitupthebutt.com would you consider that libelous.

\Or if someone put up a website www.doesenemabagjonesloveitupthebutt.com I might be sort of complimented in an offhand way.

I have some experience in this area.

If a Postal Inspector was called in it's because some type of mail fraud was suspected.  That's the only reason they EVER get called in.  The OIG (Office of the Inspector General) investigates mail fraud.  So presumably this guy must have done the domain registrations through the mail or received something through the mail that was mis-representing something/someone.

The Postal Inspection Service does not Fark around.  Remember the moved "Buch Cassidy and the Sundance Kid"?  The Feds who were on their trail were the USPS Inspection Service.  You can steal all you want, but once you fark with the mail they will own your ass.

Do not fark with the mail.
