Normally I deplore gun violence, but in this case I really don't see much of a downside.

Malley claimed "he had the right to point his rifle at the individual because he had reasonable suspicion to believe a crime was occurring," according to the probable cause statement. He identified himself as a "militia Minuteman."

He was just standing his ground.  Maybe your guys should show better ID.

Arpaio, whose county doesn't run along the border but has seen an increase in drug and human trafficking, warned there will be "chaos if you're going to have private citizens dressed just like our deputies taking the law into their own hands."

Well, Joe, if you and your government agency is failing to protect citizens from threats from over the border, they have no choice but to take matters into their own hands.

Dear Sheriffs:

Any dumbass can buy a patch that says "SHERIFF" and stitch it onto a bulletproof vest.

http://www.patchsupply.com/Police-and-Sheriff-Front-and-Back-Patches -w ith-Velcro.html

That's one website out of a thousand.

Thousands of people impersonate the police every year.

Not only that, you did give this guy probable cause to believe you were a dangerous smuggler or drug dealer, because that's exactly what you were trying to mimic.  You went out there to convince people you were a smuggler or drug dealer.  When you do that, you're going to run that risk.

Shootouts between Sheriff Joe's Derp Brigade and those asshole Minutemen militias.

Yeah, I'm not really seeing any downside here.

As long as they go out to the desert and shoot each other away from normal people, sounds like a win-win all around.

Who are the good guys in this scenario?
None of the players - cops, illegals and vigilantes - have a very good PR department so I'm guessing none of them. So if there's no good guys then I don't really care what happens.

As much as I despise Arpaio, I agree with him in this case.  People trying to "play cop" can lead to very bad outcomes.

There may have been a recent incident supporting this, but I'm sure it was just brushed under the rug by the news media.

Nominally, the "GOP civil war" is just a way for the congresscritters to come to the bargaining table about the debt limit and protest that they're being reasonable despite all of the pressure they're facing in their constituencies. The tea party remains, as ever, an uncritical instrument of partisan hacks and 'news' folks.

That doesn't have much to do with Sheriff Joe.

Another deputy eventually arrived and arrested Malley for aggravated assault

Richard Malley, 49, was heavily armed with two others dressed in camouflage Saturday night along Interstate 8 near Gila Bend, a known drug-trafficking corridor in the desert about 70 miles southwest of Phoenix, when he confronted the deputy who was on patrol conducting surveillance, authorities said.

Mexican Man Arrested For Mass Murder
Police Officers, Minutemen Found Dead Near Border

PHOENIX - A Mexican man claims he did not murder anyone after he was arrested for being spotted near over two dozen bodies near the Arizona-Mexico border, authorities say.

Sheriff Joe Arpaio said that the man was crossing into the country illegally and had killed about 30 police officers and minutemen, whose bodies were found in separate groups in a portion of the barren lands between Arizona and Mexico. Shell casings, empty clips, Glocks, and AK-47s riddled the area around the corpses, suggesting that "the Mexican man had gotten into a firefight with the two groups, who were obviously working together to catch this madman," Arpaio said.

Forensic ballistics reports were "lost, and we are trying to recover them," Arpaio said.

The Mexican man had only this to say: "Me llamo Nestor de la Cruz. Tengo mi ciudadanía el año pasado. No he matado a nadie. Acabo de ver los cadáveres y traté de informar a la policía lo más rápido posible," which according to a Maricopa County Sheriff Department-supplied translator means "I used to assassinate politicians for drug cartels, so 30 gringos with guns was easy work for me." Arpaio says that the man will be dealt with appropriately. "I've got a prison tent with Jose Lopez written all over it," he said before dismissing the press conference. "There is much work to be done now, if you'll excuse me."

A representative of the Arizona Minutemen for Border Protection said to us anonymously that they will also be doing all they can to keep Mexicans from killing them in the future, and warned against Mexicans dressed as police officers in order to get through the border and into America. "Those Mexicans are sneaky. It is their nature," he told us. "We are just trying to protect the country and the jobs from these smelly, sleazy [not-racist term involving the moistness of the opposite of a front]. It's not about race, it's about safety."

No, you don't have the right. You are a civilian, not a law enforcement. You do NOT have the right to point a rifle at anyone unless you are under the threat of bodily harm. If the cops tell you that they are the cops, you better drop your gun right that second.

Now that good ol boy Joe said that, if you are a person who likes to carry a rifle to secure your own neighborhood then you need to understand that should you end up face to face with some law enforcement officers you might have no other choice than to shoot first.  Nobody will blame you....other than the courts and police, so don't bother reporting what happened out there.  Best to keep a shovel in the trunk just in case.  Thanks Joe!  Yer doing a hell of a job as usual....

If his deputies when outside of their jurisdiction when they were "impersonating drug smugglers", then they were "playing cop" too.  Assuming they weren't actually smuggling drugs, that is.

Maricopa County is not a border county. Since it is not a border county, they cannot see an illegal border crossing happen when they are in Maricopa County. Given that information, I have to question what these farksticks' game plan is. Brandish their weapons at any one who might be Mexican?

The deputies plan was equally stupid. Drive out to the desert and honk the horn of a truck loaded with guys "clearly marked with sheriff's patches"? Genius plan, guys. Keep at it, I'm sure one day you'll find someone besides old guys playing vigilante dress-up dumb enough to fall enough for that.

Sock Ruh Tease: Mexican Man Arrested For Mass Murder

So, what you're saying is that a bunch of ill-trained clowns with Tapco'd SKSs and Bushmaster AR-15s would get killed when fighting someone who knows what they're doing?

It's called "Citizens arrest."  It is a commonlaw right that has been narrowed by statute.  It depends on the state you are in.

Took me two seconds to google this.
A private person may make an arrest:

1. When the person to be arrested has in his presence committed a misdemeanor amounting to a breach of the peace, or a felony.

2. When a felony has been in fact committed and he has reasonable ground to believe that the person to be arrested has committed it.

Now, as to the amount of force you can use to effect the arrest, and the definition of all those terms, you're going to have to do legal research into the cases in Arizona.

No, it isn't, Neither is Pinal County, but apparently there is a pretty big corridor right through the area where the people funnel through. Normally, Joe is more interested in getting good press than actually enforcing the law, but that desert is some seriously empty land, and they just have to walk right up to I-8 right there, so the trucks pull over, they get in and leave. It makes sense to have stepped up enforcement out there. Nothing else the Withered old Fool does makes sense, but that one does.

Yes the sheriff gave that civilian probable cause to think he was a drug dealer, so that pretend cop out trying to do the job of the real cop, and instead getting in the way was totally in the right. Unfortunately for you, Maricopa County is just a little bigger than Phoenix, so it's closer to 30 miles from the border... Sheriffs enforce over the ENTIRE county, not just the cesspool parts like Phoenix. Not that Joe isn't normally a shmuck, you've just picked a weak position to base your argument on.

Looks like Maricopa County does extend way south from Phoenix and Gila Bend is certainly inside the county. Still not the border, and about 70 miles south, near Interstate 8. So, it's Joe's problem.

Texas had a problem a while back with some dudes from Kansas or Nebraska or Missouri claiming to be heirs to the Republic of Texas. They holed up in the Davis Mountains in the desert in the 600 miles stretch between San Antonio and El Paso. They were hurting the local people. A bunch of bad asses playing post Apocalyptic war lords in the desert. The wanted another Waco, even if they had to steal women and children from the locals to get the body count up for their compound.

What sheriff doesn't welcome the fame of minimum wage TV anchors claiming they'll show the Next Waco right after these messages?

There are actually some great national parks in the general area of Gila Bend, once you realize that a short drive is a 100 mile round trip. Scare away the tourists and you're doing your state a great economic favor.

One flaw in your argument: The militia guy is not law enforcement. He has no business trying to prevent a non-violent crime, particularly by using the threat of violence. He's still a cop. Why do you ask? These cops were inside of their jurisdiction. A simple search for "Maricopa County" and the ability to read a map will show you just how much of that area near Gila Bend is inside the county's borders.

thurstonxhowell: Maricopa County is not a border county.

No, it's not a border county. What it IS is a county that includes a major smuggling corridor that has a US Interstate running through it, 20-30 miles from the edge of the county boundary, and a prime spot for drug and human smuggling couriers to just pull to the side of the road, load up, and be anywhere they want within hours.

It's also not exactly a high use recreation area, since it is mile after mile after mile after mile of ugly, blasted desert, this isn't even the "majestic beauty" kind of desert, or the "hidden springs in the mountains" kind of desert. As someone mentioned, NOBODY goes there if they don't have to, it sucks. hell, I can't for the life of me figure out why people even live in Gila Bend. Except that they grow a shiat-ton of shrimp out there, apparently.

Because of people from OUTSIDE of Arizona. Snowbirds can vote. I think they only have to be in the state 3 months of the year(Maybe 4) to vote in Maricopa County elections. What happens, is your Great Aunt Betty up in Moosefart, Minnesota watches Fox News all day long, hearing about how "scary" all of the big cities are. She comes to Az in the winter, because nothing beats having snow like the same farking weather day in and day out... When she comes to Mesa, Sun City, Gilbert, Phoenix, wherever, she notices that she hasn't been carjacked, beaten, robbed, raped, or kidnapped, so she makes the ASSumption that it is because the County Sheriff is doing his job, when in reality, he has about 50,000 felony warrants gathering dust and his department ignored more than 400 sex crimes in El Mirage while their boss made it in front of every news camera he could.

She casts her vote, goes back to the motorhome and has some mimosas, and when March comes along, she goes back home, with not a single thought about what might have happened as a result of her misinformed voting practices.

That's how he keeps getting elected. Hundreds of thousands of clueless blue-hairs.

these sick assholes are going out there in the hopes that they'll be able to kill a mexican. that's the only reason they're there - to play soldier boy with live ammunition and live targets.

Yeah, I'm not so sure that's the only motivation the militiamen may have. It seems to me from the scenario in the article, that the militia intended to detain, or otherwise hold prisoner a suspected drug smuggler. So, it would be a fine, fine payday to detain a drug smuggler, and take possession of their cargo - whatever that may be. If it was a scenario where the smuggler was dealing in humans, the militiamen could have taken possession of them as well. Either the militiamen could be Arial Castros, or Don Corleones... they could be out there, not to simply shoot Mexicans, but to profit by pirating the smuggled cargo.

Yeah, I've thought the whole minuteman movement was pants on head from the beginning. Then again, I've talked to some off the people who have been hit by all of the illegals crossing their land. And this was in the late 90's, early 00's, when this was first starting to be a 'thing', some of these people have a valid argument. Exactly.  And why is there such a porous corridor there?  The Tohono O'odham reservation's northern border is in southwest Maricopa County.  The reservation extends to the Mexican border.  And the Tohono O'odham consider land south of the border to be "culturally" theirs as well. Border enforcement by the tribal police is meager, if at all.  U.S. Border Patrol does not patrol on reservation land.  But, they sure do heavily patrol the periphery of the reservation.  Thus an effective border is indeed in Maricopa County on the edge of the res.

http://pulitzercenter.org/reporting/clash-border-tohomo-o%E2%80%99od ha m-nation-migration-Mexico-Arizona-Native-Americans

I learned all this about a month ago when photographing some Monsoon storms on that reservation.  Border patrol had a word with me as soon as I exited the res.

Sock Ruh Tease: Mexican Man Arrested For Mass Murder

It's the steam pipe trunk distribution venue.

UrukHaiGuyz: charmbomb: CygnusDarius: re great people in Arizona than I've met assholes that might agree with Sheriff Arpaio, then again, my circle of influence in Arizona is Nogales, Tucson, Phoenix and Flagstaff, so it's rather limited. Why is this guy still in charge of Maricopa?.

Graffito: thurstonxhowell: and, while PA usually goes blue, I'm betting Shanksville does not.

What's your reasoning there?  I don't know much about Shanksville except that it is rural, and rural areas often go red.
As far as 9/11 goes, that was on W's watch and we have had no foreigners attack us on home soil since then.

I was born and grew up about 10 miles from where Flight 93 went down. My Aunt lived 2 miles from the crash site.

My parents were lifelong Republicans, but in general, I think the area was reasonably mixed. The folks seemed to me to be fairly intelligent, friendly, and tolerant.

I grew up Republican, but it's been over 2 decades since I voted for a Repub, with only one exception - a local rep who obviously cares about the welfare of all his constituents. I live in the DC suburbs now and tear the GOTP a new one every time the send me a survey.

Anyway, my corner of PA really did seem like a Norman Rockwell upbringing to this farm kid.

Rixel: (Figure One): Understand the procedure now?
Just herp a bit here, derp a bit there. . . . Throw
them into darkness for a few hours, and then
just sit back and watch the pattern.
(Figure Two): And this pat tern is always the same?
(Figure One): With few variations. They pick
the most dangerous enemy they can find . . .
and it's themselves. And all we need do is sit
back . . . and watch.
(Figure Two): Then I take it this place . . .
this Maple Street . . . is not unique.
(Figure One): (shaking his head ). By no means.
Their world is full of Maple Streets. And we'll
go from one to the other and let them destroy
themselves. One to the other . . . one to the
other . . . one to the other-

I see what you did there.

Somewhere, Rod Serling is smiling.

Bravo Two: So, remember kids, shooting people is bad and wrong, except when it's people we don't like, then it's perfectly fine.

Correct. People don't shed tears when criminals or idiot rednecks kill each other.

thurstonxhowell: Freschel: Either this didn't happen or over 30 armed men were not able to kill one person.

/Crap I fed a troll

Calm down, sparky. It was a joke. You ever hear of The Onion?

Eyup realized it was joke after I posted that. Live and learn =/
