Given that something like 80% of the worlds population has the herp already, i wager she probably had it to begin with and is engaging in a smear campaign because she was in love with him and thought he'd leave his "estranged" wife to be with her.

It's pretty infectious.  Depending on the location of infection and your HSV variety, you can get it through non-sexual contact as well.

What she's gonna need is proof that he sought treatment in the past, knew about it from ex-gfs, or something.

Seems like they were together for a while.  I doubt getting herpes was the straw that broke the camels back, and if it was, she deserved it.

He'd have to do a lot of raping -- the actual per-exposure chance of transmitting HIV is pretty low: something like 0.30% (per act) from a man->woman point of view.

AIDS, I think, was treated differently because it was a fatal disease. I know some people were charged with attempted murder for not revealing their HIV status or for intentionally going out to infect people with HIV, but herpes does not fall under the same criteria.

Seriously.  I need to sue that kid Mark in my fifth grade class for giving me a life-long herpes infection.  Of course, I didn't give it to anyone but my little sister.

If i remember correct, chicken pox is the same family of virus as the herp, so if you got the pox as a kid, congrats! You got the herp! That is why herp tests are not 100% reliable and require multiple re-tests to be sure; chicken pox often throws a false positive on herp tests.
