Good.

2013-08-19 11:08:10 AM
"Stand your ground" is already being discussed, when it is apparent, based on the story presented, that she tried non-violent intervention in a clear-cut assault/battery situation and was attacked.  If you're pinned to the ground, you cannot retreat and thus "duty to retreat" doesn't come into play.  Self defense, as presented.

Note that I said "as presented;" the sources quoted were the shooter and the woman that the dead guy was beating with a pipe.

Don't bring a pipe to a gun fight.

From the information presented, totally justified.

For some reason the victim's incredulity at the guy's actions seem to make the story more believable.  Like he just snapped (although she described a typical, ascending pattern of abusive behavior) and she's not happy that he died but resolved that it was her neighbor's only choice.

I've been on FARK too long when I assume the .45 is referring to her BAC and not her weapon of choice.

It's only marginally more useful than Skittles.

Yeah - an O.F. (Original Farker) would have assumed that referred to her beer.

FTFA: The noise awoke neighbors, including Vickie Rock, who was staying the night at her boyfriend's apartment upstairs. Rock, 50, of Riverview, came outside armed with a .45-caliber handgun and saw Robertson beating Vasilakos with a metal object, said Hillsborough sheriff's spokesman Larry McKinnon.

Like a Rock.

Ugh, Riverview. Where Northern trash moves to try and pretend to be rednecks. Avoid it at all costs.

This is good.  This is what we want.

I'm going to withhold judgement on the case until Obama tells me what family relationship they might have had.

I thought Fark Zimmermann case consensus was that you should not get shot and killed just for beating someone.

We haven't been told their races yet though, so it could still turn out to be a racially motivated murder.

Sounds more like she left and put him in his place that night.  So he started to strangle her and was crushing her face.

Stand Your Ground scores another victory.  Let's see the retards spin this one.

Was she not in fear for her life?
Her injuries don't look that bad?
Profiling him?
Came out armed looking for trouble?

THIS is why these laws exist and rightfully so.

This has nothing to do with SYG as you correctly state, and it STILL wouldn;t have if she had merely come upon the guy beating the other lady with the pipe,   Self Defense, under the law includes a transferred right to use dealy force to rescue another where that person would have possessed the right to use it.

Draw whatever parallel you like, but remember that the dead guy was (a) in the commission of a violent crime at the time of intervention, (b) was armed, and (c) witnesses make it clear that the dead guy attacked the shooter.

And we're done. Attacker with weapon, assaulting one victim, attempts to assault a person trying to intercede. Person, armed, kills attacker. Seems like the epitome of "self-defense."

She should have armed herself with a pipe so they were on even ground. Even if she had to run in and grab a hacksaw and cut a fencepost off first. I'm sure the GF could have survived a while longer whilst getting her haid bashed in.

I bet this thread gets less than 100 replies, mostly because the J4T crowd would rather gouge out their own eyes than acknowledge its existence.

No matter how many times you try to explain it, Team Trayvon will never figure it out.

Could she of opened fire when he was just assaulting his girlfriend and claim self defence of a 3rd party?

Sounds perfectly justified, to me.  (If the article is accurate, at least.)

elysive: I thought Fark Zimmermann case consensus was that you should not get shot and killed just for beating someone.

There is a difference between defending yourself from being attacked and looking at a "suspicious person", following that person, and then getting into an altercation with that person when you're job is not listed as "police officer". If you are part of neighborhood watch elysive, call the police when you see someone suspicious and let them handle it, only when that person is actually doing something to a person or property (namely yours) is the reasoning for intervening.

Is it sad that I was hoping this was a Flint story?  I hear about dv incidents and shootings all the time.  Sometimes during the same hour, but never together like this.

Just yesterday before sunrise, a shooting death, an arson and a guy beating his woman all within an hour.  The shooting was separate, however the abandoned house intentionally set on fire just preceded a guy beating his woman next door to the burning house.

Interesting double standard we have here. Where are the calls to say she should have stayed in her house, and shouldn't have approached the person armed with a handgun?

Bzzt!  so sorry, SYG had NOTHING to do with this
SYG did not CREATE the right of self-defense.  In any self defense analysis dating back to Blackstone's Law Commentaries this lady's actions would have fallen squarely into the ambit of justifieable self- defense.  SYG, for no better reason than the fact that a Florida lawmaker was bribed by an NRA lobbyist (absolutely verifiable true statement BTW) expands self defense to a level out of whack with 1000 years of American and English legal tradition.   It allow Self-defense to be invoked even in cases where the person claiming self-defense has an ability to retreat from the situation IN PERFECT SAFETY, which under classic self defense rights ended.

Of course I should learn the difference between "your job" and not using "you're job"!

The situations are totally the same, guys!! And if the Trayvon people are opposed to SYG in one case, they're OBVIOUSLY opposed to it in every case! That's not strawmanny at all!

All of which was testified to in court during the Zimmerman trial yet most folks here seemed to over look that cause the dead guy was a teenaged black male and not a wife beating white redneck.
