He'll lose. It's commercial speech, and ADULT commercial speech on top of that. The state only has to satisfy a rational basis test and it will be able to treat the strip club differently than a ballet theatre.

He needs to get the dancing to qualify as a more protected form of speech before he'll succeed, I think.

Oh, it is... but it's not a kind of speech that's based on a protected class or fundamental right. Both only reach the "rational basis" scrutiny instead of intermediate or strict scrutiny. In this case, as unfair as it is, the State has provided a rational (albeit not necessarily fair) basis for treating the two places differently.

Constitutional law was NOT my best subject, though. :) Hopefully his lawyer can find a way to differentiate dancing from commercial speech to something with a bit more protection, but I doubt it'll persuade the SCOTUS.

The article does not indicate what this tax break is that one commercial establishment must pay and the other may not. I figured since you wanted the tax break gone you knew what it was. You don't.
