The restaurant doesn't approve of beer?

2013-08-06 01:40:35 PM
But it closed in 2011 and sat empty for a year.

That's usually the problem.  Grandfather clauses often expire after a year.  An establishment in our little downtown closed for more than a year, and in the interim, a church rented the property next door.  Now their license is in limbo.

If only it were as easy to get a liquor license as it was a CCW.

To be fair, alcohol is more dangerouser - 4% of deaths worldwide can be blamed on the alcohols. Repeal the 21st Amendment!

God forbid someone doesn't want dangerous intoxicating substances in their community that will teach the children of the community that alcoholism is a valid life choice.

At a public hearing on May 8, records show that the neighbor who doesn't approve mentioned the restaurant had been closed several times over the years, and that he did not support the sale of beer and wine by the glass.

So don't buy it.  What a jerk.

But the commissioners unanimously decided to give the restaurant the permit.

McCullough said he then learned that the neighbor appealed the decision to a district judge.

Okay, now we're through "jerk" and out the other side to Unmitigated Asshole.  I can see not responding.  But to take the trouble to take it to a goddamn judge?  Seriously, WTF?

Simple solution: have two new residents move in to support the restaurant and reapply for the license.

Boom: 75% approval.

1,000 feet is pretty damn close.  If you look at the restaurant on the map, its in the middle of nowhere.

Where are these neighbors?

Meh.  They set up the law so that you need 75%.  The law requires people to make the judgment, based on moral, economic, or whatever grounds they pick (who knows, maybe the guy just wants all keggers all the time).

You can't set up the law and then get shocked when people expect you to follow it.

I'm used to you, so I'm used to your snark...but still...

But there's a major delay revolving around a beer and wine permit.
To get it, the restaurant needs 75 percent approval from the neighbors within 1,000 feet.

But this location only has two neighbors in that designated area.

 So yanno, farkoff.

CSB time:

A local restaurant was unable to get a wine & beer license because it was within 300 feet of a church. The church said that they didn't care and were perfectly happy to have a nice sit-down restaurant that contributed to the community, but county law didn't allow for that. They overturned the county law, but there was also a city ordinance, which was abolished just last week.

Turned out it worked both ways, too: somebody wanted to establish a new church on Main Street and couldn't because the places that did have liquor licenses took precedence.

If that location already closed down before, chances are that even if it opens, it won't stay open for a long time. Unless the new owners have a side business with local meth (or whatever the local drug of choice is now) dealers.

I lived in a state that had a distance from a church as a preventative factor for a liquor license (it could be over ridden if the church approved) Everything was close to a church. There is a frickin church on every other block like every one of the old British colony states.

Nah, its not an AH if the statement is pertinent to the discussion and can be supported by facts.

This guy taking the appeal to a judge qualifies him as a certifiable raging cock-gobble and seems to sum him up rather well.

There nothing Godly about it at all. The bible clearly states that alcohol is a creation of God and therefore inherently good.(1 Timothy 4:4). To be against alcohol then is to be against God and siding with the Devil. It is as simple as that. The man is a Satanist.
