The real story is that Santa Claus's wife has authority to issue legal rulings in the United Kingdom.

I have a mentally handicapped sister. She's 33 with the mental capacity of a 3 year old. When she hit puberty my mom wanted her to have a hysterectomy. The courts said she couldn't do that because it would violate my sisters reproductive rights. WTF? She basically a 3 year old and dealing with her periods on top of the concern that if someone raped her she could get pregnant...I mean...come on.

The courts tend to frown upon forcing someone who still has the legal right to make her own decisions to get a hysterectomy and be sterilized. Something about the period of 1933 to 1945 that makes them iffy about it.

/the US sterilized hundreds of thousands of people in that time for mental illness.

Pretty much. Anyone having sex with her would be charged with rape, and rightfully so. People who do not have the mental ability to give consent should be sterilized.

It's not even a matter of eugenics. Unless a court has deemed her officially unfit to make decisions for herself, and her mother has that in writing from a judge, no one will do it. Even then, you're going to be hard pressed to find anyone to do it, and insurance won't pay a dime for it. It's not medically necessary, and it's of questionable ethics.

Doctors, judges and insurance executives are all Republicans.  Demographics will doom the GOP if we sterilize the mentally incapacitated.

Courts preventing them from being together unchaperoned, and FTA: "The judge said at a hearing in London that she was 'extremely concerned' about DE's loss of independence and the effect it is having on him."

It kind of sounds like there might be some emotional abuse going on there. Best not to think of them as a cohesive married unit. She probably wants to control him while keeping her own options open.

I would say eugenics is when the state determines who should be sterilized. I would say if the state gave the parents that level of control over their mentally disabled child's health, they could decide to have the child sterilized.

In the story's case, it sounded like guy is competent enough to have an ongoing relation with a girl, AND he doesn't want any more children, so it seems an easy decision to let him have a vasectomy.

That is...an excellent alternative approach.  I'd be interested to know what brought the matter to being solely his concern.

/yes, I do understand that vasectomies are easier and cheaper

2013-08-03 02:23:04 PM
I feel like voluntary sterilizations are among the most cost effective things anyone could ever spend money on.  A quick google search says that it costs $300-$2,000 for a vasectomy.  An even quicker google search says that it costs on the order of $100,000 to raise a child to 18.  Some simple math tells me that if sterilize 50 guys, then the procedures pay for themselves if only one unwanted child is prevented.

/imagine the payback if we consider the cost of a human life, and all of the abortions that will be prevented by these 50 dudes not having kids

FTFA:   But he does not have capacity when it comes to making decisions about contraception and cannot be relied upon to use condoms or other birth control methods effectively to prevent pregnancy.

So what makes him any different from any other urban dweller?

Also, why can't the GF be trusted to put the condom on him? If she really had his best interests at heart this wouldn't be an issue. Stealing babbies from a whatever-the-PC-term-is-now. Classy move, lady.

drdank: Does retarded translate to learning disabled in British? I can't imagine that this guy has a court of protection just for having dyslexia or something.

It's a complex thing. He could have a mental illness, something like early onset dementia, or severe autism to the point where he would still be able to function to a certain extent, but require a court appointed guardian to make decisions on his behalf on the matter of complex issues.

Someone can be mentally retarded but still able to function with their Activities of Daily Living without assistance, just not have the cognitive capability for complex practices and comprehension.

2013-08-03 02:29:20 PM
The girlfriend must have mental deficiencies or learning disabilities as well.  I mean, if he can't be relied upon to use contraception and therefore needs a vasectomy, then clearly she can't be relied upon to use contraception either.

And if neither of them can be trusted to use contraception because of their handicaps, I'm also going to go out on a limb and guess that the girlfriend's vagina is sideways.  If that's true, then he most certainly keeps a lucky chupacabra paw in there, so any future children born to them is probably half human, half leprechaun.

Once the kids are born, the family will be rich, because there's always a pot of gold at the end of a leprechaun's urine stream.  However, the wealth probably will cause mental and psychological anguish for the father -- same principle as those people you hear who win the lotto, and then their lives fall apart, eventually leaving them penniless and worse off than they were before they got the winnings.

But seriously, the real invasion of rights is that the government is keeping this dude from having sex.  I mean, not all sex leads to babies.  He should at least be allowed to continue doing her in the butt.  And don't get me started on handjobs.  Plus, it's not like a chick ever got pregnant from semen in her eyes.

It's not like sterilization effects her desire, her ability to consent, or the ability of someone to screw her. It just prevents babies.

My ex and I have the same concern about our daughter.  She's nearly 5 now but is developmentally between 9-24 months (varies by area), and has a chromosomal anomaly that seems to be the cause of all her issues (some health issues in addition to the neurological ones).  Our big concerns are 1) Will she be able to understand and deal with things like menstruation, cramping, etc and 2) At some point she'll probably be living in a group home or assisted living facility and we are concerned about her being assaulted. If she were to become pregnant there's no way she could deal with the pregnancy or raise a child on her own.

I recall in the case of Brooke Greenberg - the girl in Maryland who basically doesn't age (she's 20yo, 30 inches and 16 pounds) her family was able to get her a hysterectomy at age 8, which caused quite a debate of medical ethics, but as a parent in a somewhat similar situation, I can't fault them for having it done.

And I guess we'll just hope that everyone ends up with parents who make fair and selfless decisions. It's not like mentally disabled people deserve the protection of society.

So:

1. He's able to use a condom
2. He's capable of consenting to sexual relationships
3. He's said he does NOT want to father another child
4. He's able to live semi-independently
5. He has a girlfriend and, until now, has been able to see her for sexual relations
6. Everyone agrees that he's not being forced into this and it would greatly improve his independence

So what, exactly, is the problem?
