Well.. it wasn't illegal.

The problem is that a person like that is very likely breaking the law or not upholding his office.  I said it on other threads: I've known cops with just half the attitude problem of Kessler and they are unable to separate their "beliefs" from the job.

What should be done is to look at his public interactions and whether he is treating is public right.  I would bet a paycheck that he treats the members of the public he sees as "libtards" different then his buddies.  If so that's a violation of his office.

If this guy is allowed to remain on the job, the town is opening the door to huge liability claims in the future.  When this guy farks up again.....not a question of if....the lawyers for the plaintiffs are all going to show up in court with that video.  If the people running this town don't have the balls to shiat-can this psycho, they should pay him to go away.  In the long run, it will be cheaper for them.

This is the first time in the history of America that a cop has been suspended without pay.

You mean using taxpayer owned weapons on taxpayer owned land to shoot off thousands of rounds of taxpayer ammo while filming private rants is wrong?

Given the politics of this state he is unlikely to ever face such a review. There's a reason I don't advertise that I'm a pagan and democrat in these parts...backlash and persecution is a very real concern.

He should get some kind of punishment for acting like a jack ass on the internet while holding a public office and in the uniform of that office.

He can have his own opinions, but when you express them in the uniform of the office it can be misconstrued to be the opinion of the office.

Of course he isn't in a union. He's the chief. That's management. He's at the mercy of whatever contract he personally negotiated with the town and whatever relevent state laws exist. In my state it is difficult to fire a police chief or a fire marshal because of the obvious danger of giving political leaders that kind of upper hand: "If you don' let my kid off/look the other way about those code violations, you're fired!"

Suspension with pay is only the first step of the process that, for more serious offenses, often ends with suspension without or termination. When an employee under a contract does something wrong, but not in violation of the contract, and needs to be sent home suspension without pay can lead to legal action. For example: a public works guy is arrested for a bar fight. He is free on bail and able to work while his case is pending. City policy states that employees with pending criminal cases are to be suspended. If they suspend him without pay, 1) they will have to fight grievances and possible legal action because they are withholding contractual pay and 2) when the charges are dropped/dismissed/nolled, the city would have to pay his back pay anyway, on top of whatever they spent to fight the grievances.

The city I work for, by the way, suspends without pay as the first move. They would rather have the fight and pay the back pay. It's a city that's often ridiculed on Fark for the incredibly backward way they do everything else, so it's really no surprise they fark that up, too.

Given that Mark Kessler  was the only police / public safety officer employed by Gilberton (he was the chief of a force of 0) has the city hired a replacement or they just letting the county and state cops take over whatever he did as is common in many similarly sized tiny communities?

Does Gilberton really need a police chief?

Mr. Kessler is an example of why the nation needs strict firearm regulation policy to keep certain classes of firearms outside of the possession of anyone other than law enforcement agents.

I went to that district and obviously grew up in that area. The high school is actually pretty decent and has good math and science. No anti evolution stuff going on. And someone mentioned something about unions - I don't know if the Gilberton police force has a union, but it's a very union heavy area (look up the Molly Macguires). Gilberton is a crappy little town that used to be a company town owned by the coal mine. We call these town "patches" and they're all over. It only has one bar and I don't even think they have a church.
