My brother was quite the druggie in High School, I was more the dweeb. Anyway, one day he wanted some cash so he sold hits of acid to lots of people in school. The thing was, there was no acid, it was just stickers. That is great for profit margin, not so good for not getting your ass kicked. Eventually a bunch of his friends that he sold to confronted him and let him know that there was no acid on these stickers.

His response:

"I know! Let's find the guy who sold to me and ripped us all off!!!!"

A van full of druggies spent an afternoon and evening driving around Santa Cruz looking for "a guy in a purple hat" who never existed.

Yeah, he isn't that bright, but he was bright enough! He really is a kind soul, I am pretty sure if there was a guy with a purple hat he would have said "that's not him".

Every other day, here in Atlanta, there is a horror news story about synthetic pot (a kid smoked it and drowned in a hot tub a couple years ago here). How does one get THAT stoned?

REAL pot is safer, I am guessing. SOME people get über productive when they smoke; cleaning, organizing, filing, alphabetizing, etc. SOME people are counting the days till they are no longer randomly piss-tested. SOME people will have no clue how to find it when that time comes.

Intent. The actual charge is "possession with INTENT to distribute." So it doesn't matter if you have 100% pure cocaine or ground-up aspirin--if what you mean to do is sell it AS IF IT WAS cocaine--then you get charged with intent.

Now, whether they can make the conviction stick is up to the judge and/or jury; but the arrest is good.

The close similarity of appearance between dosage units of imitation controlled substances and controlled substances is indicative of a deliberate and wilful attempt to profit by deception without regard to the tragic human consequences. The use of imitation controlled substances is responsible for a growing number of injuries and deaths, and the legislature hereby declares that this chapter is necessary for the protection and preservation of the public health and safety."

I saw an episode of 'Cops' the other day where some guy got arrested for selling fake cocaine. The cop had the guy pulled over for a traffic stop and found it in his car. The guy admitted it was baking powder and he was just trying to find someone to buy it to make some money.

If you sell something to someone knowing they're going to ingest it and it kills them, I think that's more than fraud. Hell the Len Bias law lets the Feds lock you up and throw away the key if you sell REAL drugs to someone and they farkup and overdose on it.

The thing I'd like to know is why they didn't arrest the guy who BOUGHT the fake pot?

That is the way I see it.  It should be fraud along the lines of fake watches, purses, etc.  Granted those things are faked off of legal items but still.

There was a guy locally who was caught for the 3rd or 4th time selling fake cocaine.
He refused a plea bargain of 1 year (8 months with good time) in a county jail, and took it to trial.

He's currently serving 20 years hard, determinant (it's not 3 to 6, of 10 to 15, it's a straight 20) time in big boy's prison.

Ooops?

In most jurisdictions, if you SAY it's drugs, then it's illegal to sell it, even if it's not drugs.

Technically, if I put actual oregano in a baggie and sell it as "smoke" in golden gate park, it's the same crime as if I sold an actual controlled substance.  The real joke is, if it's still in the original container, with all the FDA markings and everything, it's still a crime.
