Andrews operates a "smoke shop" in Scotia that sells incense and other smoking paraphernalia that can easily be used for other illicit activities.

Scotia is north of Albany, and well outside the jurisdiction of the NYPD.

Actually, Scotia is in Schenectady County, and the Schenectady County Sheriff office orchestrated the event.
Scotia is  160 miles north of NYC, and about 25 miles west of Albany.
So the NYPD gets to walk on this one.

Evidently the New York state legislature needs to consider legislation to substantially restrict private surveillance equipment to prevent such an incident from recurring.

1. The sheriff's department needs to be crucified over this one.
2. The woman at the end of the video saying that "I believe he was racially profiled and targeted because he was black" needs to get the fark over her Zimmerman outrage already.

Perhaps police targeted him because, oh, I don't know, he was running a friggin head shop, which police have been targeting for decades regardless of the race of the owner.

2013-07-27 04:55:40 PM
Ha!

2013-07-27 05:33:55 PM
Why did the informant flee?  He was only doing exactly what he was instructed to do.

2013-07-27 05:34:59 PM
Well, either way, respect for the owner for catching this guy planting evidence in his store.

Another article I read said there are many other shops like this but this one is the only one owned by a minority. Could be a coincidence.

You're serious? Let me laugh harder!

/ when did the NYPD worry about a silly thing like "jurisdiction"?

Yes. I'm sure the informant did this all on his own.

The NYPD is the only municipal law enforcement organization in the Nation with the ability to conduct surveillance on and issue arrest warrants for people that have never set foot in their City.

2013-07-27 05:41:10 PM
I'm pretty sure the guy who had actual rocks of crack to drop around the head shop is the one doing illegal things...

mooseyfate: Why did the informant flee?  He was only doing exactly what he was instructed to do.

He hasn't fled.  The police in that town will NEVER arrest him.  When he's facing 7 years in jail, that snitch is going to roll over on the police department so fast... which won't really work because those will be the people arresting him.

Who will watch the watchmen?

2013-07-27 05:42:50 PM
Not only can informants flee, they can also destroy everyone's good time...so I am told.

This. Thank god he had those cameras or he might have been screwed.

Deathfrogg: The NYPD is the only municipal law enforcement organization in the Nation with the ability to conduct surveillance on and issue arrest warrants for people that have never set foot in their City.

I'm pretty sure any jurisdiction can issue arrest warrants for people that have never set foot in their city (town, etc). You can commit crimes in other ways without requiring a physical presence. True, these then tend to get the State or Feds involved, but that doesn't absolve one of the crime and the local jurisdiction's right to prosecute you for it.

Good story until that stupid biatch at the end starts saying it was racially motivated. Owners and employees of "smoke shops" have been targets of police for decades because 9 times out of 10 somebody in that place either sells or knows where you can buy "smoking materials" to go along with their products.

Because black people's suspicion about cops planting crack cocaine was invented in 2012.

Perhaps police targeted him because, oh, I don't know, he was running a friggin head shop, which police have been targeting for decades regardless of the race of the owner.

Then why not plant actual marijuana? Or heroin? Gotta be some crack, hmm?

He should have sprinkled it around.

So when the guy retires early after collecting his settlement money, the police can claim they successfully closed down a smoke shop.

Genius!

I'm too lazy to check but I'm guessing crack = felony, pot = misdemeanor.  Go big or go home.

halB: Who will watch the watchmen?

Nowadays, nearly goddamn everybody. What really pisses me off about these news stories is how stupid the cops are. This isn't 1985. A store is liable to have hidden cameras.

Criminal prosecution aside, any cop involved should be fired for incompetence. That's weapons-grade stupid right there. I also support firing any cop who tries to stop someone from legally filming them in public. Yes, it's a tough job. It comes with a lot of special benefits. If you can't do it, there are many other applicants.

/if I were the one being framed, the stupidity of the cops would not be my main issue . . . .

2013-07-27 05:49:23 PM
The owner's going to jail after the dust settles anyway. I doubt the police are about to suddenly start waiting for people to break laws before they steal all their stuff and imprison them.

Even if they were to go nuts and start obeying the laws they enforce.... well, everyone's guilty of something. Transporting dentures over state lines, perhaps.

2013-07-27 05:50:08 PM
NOW he can start selling drugs out of his shop.

He's the only black owner int he area, and instead of the obvious pot sprinkles, they go with crack.

Perhaps police targeted him because, oh, I don't know, he was black running a friggin head shop, which police have been targeting stringing up and/or shooting dead for  decades centuries regardless specifically because of the race of the owner.

Yeah, even stupider. But when you can see a surveillance camera, you might as well assume there's another one that you can't see.

It may or may not have been racism.  Yes, there are racists in New York.  It is still awful a businessman was framed regardless of race, and I'm wondering if the informant was high on crack cocaine when he decided to plant it due to the fact that the cameras were in plain sight.  Now I want to go to the store and buy something and I don't even smoke.

That's why I think pervasive camera technology like this is a net positive. Sure, the government can use them to spy on you and track the movements of your car, but at the same time the cost of entry for buying cameras like this is so low that it is easy for al of these countless Little Brothers to point the camera the other way and hold the government accountable for its actions.

Lulz.

Well, time for them to raid his house and "find" crack there.
