It's getting to a point that guys are going to have to carry a breathalyzer along on dates to make sure she's not over the legal limit of consent. Drunk people do stupid shiat, sometimes they regret or even don't remember the stupid shiat they do, that doesn't mean they weren't responsible for what they did.  I'm getting a little concerned about the precedent these kind of cases are setting.


Or, howsabout everyone doesn't get so drunk that you do stupid shiat?  Or, try not to fark  women who "appeared semi-conscious with her stockings and underwear pulled down" in a parking garage?

This is sort of case in point for simple solutions to complex problems not really working out.  In the US, we tried this method, it was our 18th constitutional amendment.  You can find reams and reams of paper telling you how that turned out on the internet and elsewhere, so I'm just going to point out that it can't be summed up as "well" and leave you to Google if you don't know already.

On the more case-relevant level, "well, you shouldn't have put yourself in that position" is great advice... for your mother to say as she's bailing you out or whatever.  As an actual argument for how the law works or should work, it's really, really bad.  There are 7 billion people in the world, the probability of two of them making unfortunate decisions in the same location over the course of a day pretty much hits unity, and the law as a practical matter needs to account for that.

The next time I get blackout drunk and decide to take a cruise down the interstate and plow into a van full of nuns and orphans, I'll be sure to mention to the prosecutor that I was too drunk to consent to driving that car. I obviously wasn't responsible for my actions because I was drunk, and I can't even really remember getting into the car or driving it. I'm sure that will work.

There are times when a woman or girl goes to a party and gets drugged and/or fed copious amounts of alcohol without her knowledge and, once they are passed-out and/or incapacitated, some dirtbag violates them. That is abhorrent, Sometimes women go out to get a little strange, have a few too many, and wake up next to a troll. That's not rape. It happens to guys all of time, and we just slink off and hope that nobody notices.

I've never understood charging people with rape if they have sex with a girl who's drunk.  Because it basically says "If you drink too much, you're not responsible for your actions."  Which, if true, means that DUI laws should be thrown out the window because, hey, drunk drivers aren't responsible for their actions.

Here's the thing:

woman: you raped me, I was completely drunk and nearly passed out.
man: hey! I'm not a rapist! I was really drunk and didn't realize.
courts: sorry man, being drunk still means you are accountable for your actions

See, there is no contradiction here. Because the man undertook the action, and the woman did not. NOW if she was drunk-but-not-passed-out-drunk I'd agree with you. In my mind the case hinges on whether she was conscious enough to physically or verbally indicate consent or non-consent. If she was, then it wasn't rape. If she wasn't, than it is.

Also, I'm not lauding drinking culture here. I think if you are out alone and get so hammered you pass out in a parking-lot then you need an intervention. But you don't deserve to be raped.

Their comment wasn't referring to someone passed out drunk, just ones that's are highly intoxicated. If women are going to get drunk and then claim rape when they sober up on the grounds that "I was to drunk to make a "rational decision" then the next step is to claim that any decision you make while drunk is not your responsibility.

I think that's a standard most people would agree on - if a girl has a few tequila shots and then wants to have sex, it's not rape. If you get someone drunk, they pass out, mutter "sure" before passing out, etc, it's rape. Unfortunately, there's no legal standard. It's judged on a case-by-case basis, and you can breathalize people like in a DUI case. So if you have sex with a girl that had two beers, she could claim to have been too drunk to consent, and a judge or jury can uphold that.

The American justice system has some of the harshest punishments for men who commit rape and probably the most protection for women who are raped, which is great. But to go along with that, some things need much more legal guidelines to leave less gray area.

A few years ago in the UK there was a big scare about Rohypnhol and "date-rape drugs". We had advertising campaigns about "watch your drink" and so forth. Then, some researchers looked into all the cases of rape and all the cases where the woman was sure that she must have been slipped a roofie and well, it was actually a tiny percentage of them. Most of them just got drunk.

And there's even research been done into the effects of alcohol on women: they become like men. They will fark anything. A guy, yeah, we're more likely to fark an ugly woman because of alcohol, but we're fully aware that we do that. "oh jesus, no I didn't". Try and get out of the house before she wakes up. A woman believes that the only way she could have done it was under duress.
