The prosecution has told jurors "there was no way [the alleged victim] was remotely able to give consent".
Crown prosecutor Tony Jacobs described the woman as "completely helpless" that night after consuming significantly more alcohol than she usually would at Salamanca bars and the Taste of Tasmania festival.

So whores, chicks on speed, and fat chicks are fair game, but he wouldn't ever touch a drunk chick.

The guy has standards!

And if someone steals your fence and then tries to sell it down the local pub whilst waving an epee around, then you could say they are "fencing your fence whilst fencing".

This is sort of case in point for simple solutions to complex problems not really working out.  In the US, we tried this method, it was our 18th constitutional amendment.  You can find reams and reams of paper telling you how that turned out on the internet and elsewhere, so I'm just going to point out that it can't be summed up as "well" and leave you to Google if you don't know already.

On the more case-relevant level, "well, you shouldn't have put yourself in that position" is great advice... for your mother to say as she's bailing you out or whatever.  As an actual argument for how the law works or should work, it's really, really bad.  There are 7 billion people in the world, the probability of two of them making unfortunate decisions in the same location over the course of a day pretty much hits unity, and the law as a practical matter needs to account for that.

2013-07-24 03:27:32 AM
The next time I get blackout drunk and decide to take a cruise down the interstate and plow into a van full of nuns and orphans, I'll be sure to mention to the prosecutor that I was too drunk to consent to driving that car. I obviously wasn't responsible for my actions because I was drunk, and I can't even really remember getting into the car or driving it. I'm sure that will work.

There are times when a woman or girl goes to a party and gets drugged and/or fed copious amounts of alcohol without her knowledge and, once they are passed-out and/or incapacitated, some dirtbag violates them. That is abhorrent, Sometimes women go out to get a little strange, have a few too many, and wake up next to a troll. That's not rape. It happens to guys all of time, and we just slink off and hope that nobody notices.

2013-07-24 03:32:09 AM
I've never understood charging people with rape if they have sex with a girl who's drunk.  Because it basically says "If you drink too much, you're not responsible for your actions."  Which, if true, means that DUI laws should be thrown out the window because, hey, drunk drivers aren't responsible for their actions.

Here's the thing:

woman: you raped me, I was completely drunk and nearly passed out.
man: hey! I'm not a rapist! I was really drunk and didn't realize.
courts: sorry man, being drunk still means you are accountable for your actions

See, there is no contradiction here. Because the man undertook the action, and the woman did not. NOW if she was drunk-but-not-passed-out-drunk I'd agree with you. In my mind the case hinges on whether she was conscious enough to physically or verbally indicate consent or non-consent. If she was, then it wasn't rape. If she wasn't, than it is.

Also, I'm not lauding drinking culture here. I think if you are out alone and get so hammered you pass out in a parking-lot then you need an intervention. But you don't deserve to be raped.

Their comment wasn't referring to someone passed out drunk, just ones that's are highly intoxicated. If women are going to get drunk and then claim rape when they sober up on the grounds that "I was to drunk to make a "rational decision" then the next step is to claim that any decision you make while drunk is not your responsibility.

m00: See, there is no contradiction here.

I think that's a standard most people would agree on - if a girl has a few tequila shots and then wants to have sex, it's not rape. If you get someone drunk, they pass out, mutter "sure" before passing out, etc, it's rape. Unfortunately, there's no legal standard. It's judged on a case-by-case basis, and you can breathalize people like in a DUI case. So if you have sex with a girl that had two beers, she could claim to have been too drunk to consent, and a judge or jury can uphold that.

The American justice system has some of the harshest punishments for men who commit rape and probably the most protection for women who are raped, which is great. But to go along with that, some things need much more legal guidelines to leave less gray area.

It happens to guys all of time, and we just slink off and hope that nobody notices.

A few years ago in the UK there was a big scare about Rohypnhol and "date-rape drugs". We had advertising campaigns about "watch your drink" and so forth. Then, some researchers looked into all the cases of rape and all the cases where the woman was sure that she must have been slipped a roofie and well, it was actually a tiny percentage of them. Most of them just got drunk.

And there's even research been done into the effects of alcohol on women: they become like men. They will fark anything. A guy, yeah, we're more likely to fark an ugly woman because of alcohol, but we're fully aware that we do that. "oh jesus, no I didn't". Try and get out of the house before she wakes up.

Pretty much this.  It sucks, because the dude may not have realized she took a quick turn to pass out alley after their little make out session.  However, if you're the one making the decision, even if all your faculties aren't present, the guilt lies with you.  That is a far cry from "I wouldn't have slept with him if I were sober", and I think it all comes down to just how conscious the other person was.

Here's a fantastic rule of thumb that should work even if you're drunk (i.e., a sign that is near impossible to miss).  Continue to kiss the partner throughout coitus, if she's not kissing back, she's passed out and you need to call her a cab.  The fact that her body is still moving or her head is lolling from side to side isn't a good enough indicator that she is conscious.  Or you know, just don't chance it with chicks that appear to drunk to begin with (though I could see that as being difficult if you are equally wasted).

This is my concern as well.

Guys commit "rape" if the girl is underage EVEN IF THE GUY DOESN'T KNOW IT.
Guys commit "rape" if the girl is too intoxicated to consent EVEN IF THE GUY DOESN'T KNOW IT.

Are men supposed to be omniscient like god?  We're supposed to magically know the age of everyone?  And we're supposed to magically know if they're across their individualized "I'm too wasted" threshold? (regardless of what MADD wants you to believe, everyone does have different alcohol thresholds)?
Even if you're in a 21+ club and they ID everyone at the door you're still not immune.  Even if the girl grabs you and pulls you into a park to have sex, you're not immune.

If we are working on the assumption that the willingness of girls beloved by gravity are equivalent to prostitutes we still don't have enough information since we don't know how the defendant feels about prostitutes. He could feel that since he's offered to pay then he's owed sex. The statement wasn't so much about this case as it was about the idea of women who get drunk and claim rape when they sober up, which if you have been paying any attention to current events lately, is becoming a thing.

2013-07-24 11:50:29 AM

imfallen_angel: No?

Sure but you are more evil.

Men, in order to be satisfied, need time, money, girls, and sex.
So: Men = Time * Money * Girls * Sex.
And: Time = Money
Therefore: Men = Money2 * Girls * Sex.
Also men want to have sex with as many girls as possible so: Girls = Sex
And: Girls = Evil
So: Evil = Sex
Therefore substituting for Evil we get: Men = Money2 * Evil2
Because money is the root of all evil we get:Money2 = Evil
In summation, by substituting Evil for Money2 : Men = Evil3 while Girls = Evil. Men are more evil then Girls.

FatPrincess: Men are more evil then Girls.

Not exactly, you fail to see a serious flaw in your logic.

Men must invest this money and time to have these two equal a woman.

A woman doesn't invest in a man, but tried to change him.

So while

[woman = time and money she receives] to a man

to a woman: [man = time and money given / change ]

so...

man = evil /change (x)
and since change is an infinite variable, then this variable is fluid according to the woman and the level of change she wants to commit to,
so
man / evil * x

and

woman = time and money she receives, which can be infinite.

so
women = √(x²) = |x|

and we can formulate the results at this point:

man = fraction of the evil of a woman, the more she tried to change him, the more evil she is and the less he is.

and

women = absolute evil

sendtodave: Dante87336: In a twisted and sick way, it is true. Rape is about domination, not about sex.

This is "she was too drunk to consent" rape, not "he held her at knife-point" rape.

That's the same root thing, though. Just different ways of going about it.

Did you get caught raping someone once (only once?) or something? If you didn't get convicted, you should just be glad you got away. Stop whining.

proteus_b is a RAPE LIAR because he says that those who do not agree with his opinions are rapists. No more tolerance for rape liars. It must be stopped.

What about women who lie about getting raped?
What about rapists who lie about their age?
What about liars who said they raped someone?
What about someone who lies but agrees with proteus_b?
What if proteus_b raped someone but they lied and said he didn't rape them but you knew for a fact that he did but you didn't report it which is almost the same a lying since it was lying by omission?

I may be a RAPE LIAR, but at least I don't rely on caps lock to make my point.

/I also don't have sex with children or small animals the way that you do....

See the RAPE LIAR squirm like a weasel.

Got you there! I LIKE squirming like a WEASEL. That's EXACTLY what I LOVE to DO. There's nothing I like more than SQUIRMING like a WEASEL. The only thing I like better is being a RAPE LIAR.

I don't see the point of sex with a passed out woman. If you want sex with someone completely unresponsive... just get married.

THE GREAT NAME: OK, the RAPE LIARs have arrived:

TatdGreaser and Nurglitch: The opinions given by the men in this thread represent a common view held anong a great many people (including many women). Your suggestion that they should be treated like dangerous criminals is a RAPE LIE.

ambassador_ahab: Your claim that only a small percentage of rapes are reported is a RAPE LIE.

All we need now is for some RAPE LIARs to try out the old "I was sort-of raped once so your argument is invalid" rubbish and the thread will be complete.

Hey, Mr. Expert Guy.  I'm a Criminologist.  Show me the statistics to back up your assessment that these are lies.

The one about "only a small percentage of rapes are reported" being a lie is already simply false because a small percentage of ALL CRIMES are reported.  This is what creates the "Dark Figure of Crime", that nebulous amount of crime that is greater than the amount being reported.  Efforts have been made to find ways to identify unreported crimes, and indeed statistics gathered using crime victimization methodology have found a larger number of victims of all crimes of all types at all times who did not report.

So, you have to come up with some form of evidence (difficulty:  Not from an MRA website) that rape is reported in numbers that come in stark contrast to every other crime in the world.  Get to it, champ.  I suspect this should not take long.

Good thing you didn't hold your breath- you'd be dead by now.
