The guy has a bad attorney or was incredibly stubborn if he said that. If he thinks that comment makes sense, he might have so little empathy or self-awareness that he actually committed the crime. Being a dumbass shouldn't automatically convict him, however.

It's getting to a point that guys are going to have to carry a breathalyzer along on dates to make sure she's not over the legal limit of consent. Drunk people do stupid shiat, sometimes they regret or even don't remember the stupid shiat they do, that doesn't mean they weren't responsible for what they did.  I'm getting a little concerned about the precedent these kind of cases are setting.

Nah, its still a fence.

And if someone steals your fence and then tries to sell it down the local pub whilst waving an epee around, then you could say they are "fencing your fence whilst fencing".
