I'm going to have to disagree and say that human beings pretty much know cruelty when they see it.

Actually, that's something of a misrepresentation of what the defense is arguing. The defense is essentially making a "legislative intent" argument. Their argument is that:

(1) When the legislature created the "especially cruel" standard that standard was decided by a judge.
(2) SCOTUS intervenes and say, "no can do. That has to be decided by a jury."
(3) Since the legislature did not create the standard with the intention of it being done by the jury then it can't be done by the jury and has to be thrown out.

The problem with this logic is its premise. Simply because the legislature enacted the standard when judges were implementing the DP doesn't mean that the legislature enacted it with the intention that they be the only ones implementing it. The legislature may not have given two hoots as to who was evaluating the facts.

In essence, the defense is making the argument that IF the legislature knew then what they know now they would have done something differently. To which my response is that if the legislature was so hot and bothered by the intervening SCOTUS decision they could have changed the law but they didn't.

On the other hand, AZ is in the 9th CA and the 9th tends to be anti-death penalty. So I see a route where the defense exhausts their state remedy and then go whining to the 9th hoping to get a good panel.

Actually, it doesn't. Women almost never kill and attractive women never ever kill. In our cultural ethos women who have power over people's lives are not allowed to be sexy (Hillary Clinton, Margaret Thatcher) and women who are sexy aren't allowed to be physically powerful (see 99% of most pornography ever made). Jodi combines sex and death in ways that people find intriguing and threatening. She is "killer sex". Men want her and are terrified of her at the same time.
