The way the legal system works, a willingly committed crime requires both an action and an intent. If a person does not have the mental capability to understand their actions, they cannot be said to have intended it. On the other hand, no matter how deluded someone is, they can still be considered sane if they understood at that moment that they committed a crime.

At one of my previous jobs we had a foreign guy who's first name was Bashir. One particularly simple-minded female employee always unintentionally pronounced his name "Brassiere".  I don't think he ever noticed, but it always made me crack up.

Also this wasn't an insanity defense - it doesn't address his mental state at the time of the crime. This ruling just says right now he's not competent to stand trial as he cannot assist in his own defense/understand the court proceedings. If his treatment works and his mental problems are controllable his trial will continue then. Since it's a cop killing and the courts tend to be oh so lenient on those... he'd be crazy to be sane now.

He didn't kill the cop, but otherwise, you are correct.

This is sad. The guy seems to be having a problem with reality. Too bad it took shooting another person to get him some help.
