Interesting to see the Blaze and MSNBC apparently sharing sympathies with this man.

Also, if I win several hundred million dollars in the lottery, can I just call up the court house and spring as many people as I'd like?

2013-07-11 08:07:30 PM
Yes, you can.  If I had $500,000 to blow on the bail, I would tell the defense attorney that the bail money would be his if he defended the kid in court.

2013-07-11 08:09:43 PM
If someone wanted to sue the guy for  emotional distress, they'd get tossed for not having suffered any actual damages because the threat is nonspecific. Funny, you can prosecute a non-specific threat though.

That judge should be sanctioned. It's unconstitutional what they did.

I hope to god this kid's publicity enables some good to come out of this...a college scholarship, etc.

lets not forget folks, the kid WAS a jackass. you can't threaten to shoot up a kindergarten and eat the kids hearts nowadays with out fear of repercussion. people are a little high strung about that nowadays after all with that kid that shot up the elemetry school and killed all those tweeners and all..

I know.. I KNOW OMGTHAWTCRIMINAL1984WHARGARBL!!!!!

I get it.. I really do...

but, uh,,...try not to threaten to shoot and kill kindergarteners and eat their hearts on the Facebooks  because OMG J/K! is not that much of a defense for all that anymore, and being thrown in solitary is not supposed to be pleasant  so don;t get all teary when people call you on your depressed and special needs threats

you only get to be a precious little snowflake and get participation trophies for so long.

No, I think he should face some kind of repercussion. But 5 months (some in solitary) is a bit steep of a punishment, and well, a TRIAL first would be kinda nice, too.

Contingent fees for criminal defense violate ethics rules.

This kid has to learn:

You can threaten anyone you want as long as you preface it with God.

I was thinking the same thing too - aren't we supposed to have a right to a speedy trial? Since when is 5 months "speedy"?

Also - this kid and what he did are both stupid. What he probably needs is a month at a military bootcamp to sort his dumb ass out or some sort of spanking.

Except that most of the mass shooters in recent history made no threats whatsoever before they did their shooting.

1) from context it's really obvious he's joking (hell, even out-of-context it's pretty obvious), and 2) who hasn't posted something stupid or inflammatory online at one point? I'm really glad I got all the stupid-teenager shiat out of my system on anonymous messageboards back in the day.

But yeah, you keep up with all the alarmist talking points and authoritarianism, I'm sure locking this kid up with hardened criminals is really keeping your children safe.

Thanks for camouflaging people who are actual threats, you poor little misunderstood snowflake.

Hell, he might as well go ahead and do it if they're gonna jail him for it anyway...

Read to me like he was looking for a critique for rap lyrics

that's the thing he didn't threaten anyone. His comment is not a threat by any objective measure. And yes labeling it as a joke is a sufficient defense.

No, I don't either.

I'd agree, normally, but the commentary on this has included the fact that he added text saying "lol" and "j/k" to the end of the posts.

Stupid? Sure. Immature? Absolutely. Brainless and completely lacking in any capacity for forward thinking on the consequences that could follow? You bet.

Criminal? Yeaaaaa..... I don't know about that..... this, to me, rings the same bells as those PA prosecutions of kids who sent nude pics of themselves to other kids their own age: some dipshiat prosecutors feels like he's gotta protect kids from themselves by ruining their lives and enhancing his own career....

If I had several hundred dollars to donate, I would rent that kid a decent hooker and a hotel room. If it were legal, I mean. Because I don't want to be charged with solicitation.

Really though, the kid would probably really enjoy it and after what he's been through, he deserves a little fun.

2013-07-11 09:38:14 PM
Doesn't this kid have 1st Amendment rights? Or are we just tossing those out the window now, too?

And that's the problem with the "reasonable person" standard.  They're so hard to come by.

I would say that I'd like to beat you over the head with a feral cat, but you'd probably call the FBI on me.

With this one, the U.S. government has officially jumped the shark. This is about as far from "the land of the free" as is possible.

You can make movies and glorify it through all media outlets though.  So how many more people do you think this kid poisoned with his idea or terrified?  He was not specific about where and when he was going to do it, so in my opinion, this was just sarcasm, and probably just as bad of some of the stuff you read in here.

I am going to rape every Farker.  How? Chop off their head and have sex with it.
\Sarcasm, or was it?
GG Allin made a career singing tunes about these things, or worse.  He even killed the Boston Girl, unfortunately I was unable to watch as he wished..

When logic is taken out of the court system, we are on the brink of collapsing as a society.  I understand that he should of been reprimanded for this, but a fine would have been sufficient.  Like pulling a fire alarm in an apt building.  So he will have a serious crime on his record for something he was just kidding around about?  The judicial system is a joke sometimes.  I guess we have to wait 10 years to make fun of something.
Thanks Obama.

I get that the kid acted like an idiot, but there are people who get less time behind bars for ACTUALLY killing others (texting while driving, for example).

Short of an accused mass murderer, no one should have to languish in jail prior to trial and conviction simply because he can't afford to make bail.

Do you really think he's deserved to be in prison since mid-Feb for this?  And bail that high?  Have you been to jail?  I was there for 24 hours back in Feb in Texas for less than a gram of weed.  In stoner terms, it was enough to pack one bowl.  Childress, Texas to be exact.  I'm also 45 with no priors.  Never been in bad with anyone before.
My 24 hours were a joy ride compared to what this kid is going thru, and I would not want to go back there for another hour.
And I would have bailed him out had I had the money.
Farking Childress...
..and I love Texas.  Well, Travis County.

also by "kid" we mean 19 year old adult male. he could vote, go to war and all the other things you get when you reach the age of majority. it annoys me to see him called a kid. he's a legal adult and responsible for his own actions

The fact that this case has not generated more widespread outrage is immensely disheartening to me. Hearing that someone anonymously posted bail for the kid helps quite a bit. Nifty.
