The real question is -- was the actually any marijuana in the car?  Cuz if there is and that's what the cop is smelling then this seems like a valid stop and beardguy is just being a pedantic street-lawyer jerk.  If there is NO pot in the car then the cop is lying in order to create probable cause to search and arrest and assault beardman and his family.

As much as I think beardo comes off as a jerk, I'm not exactly going to give the cop the benefit of the doubt considering that the people who wear his uniform aren't known for their truthfulness and adherence to the law as much as they're known for "testi-lying" and shouting "stop resisting!" while they beat a guy into a coma.

That's some great parenting there. When does standing up for your rights trump not traumatizing your kid? Get your ass out of the car, explain what's going on calmly and let him look. If you don't have any weed you and things escalate you have video. If you do have weed go calmly to jail with a smile on your face and say 'it's ok honey, daddy has to help the cops with something'. You should never put your kid through that drama. Scumbag!

Putting links of lawsuits, when under federal law if the plantiff receives $1, then the police department has to pay for the attorney fees, no matter if they are $1,000,000, then you have plenty of lawyers who will sue police departments for anything. That is not a good example of what you are talking about.

At no time will shouting random phrases at a police officer EVER end with that police officer walking away.  Beardy la Douche  was video-recording, which should have been enough to document any 'over-reaching' by the police officer--who never even questioned the video recording.

Just because there has ever been police misconduct does not give you the right to ignore all police everywhere.

And if you WERE smoking pot in a car with your kid there, you deserve to be tazed until the battery drains.

Wish I could have tased him - what a JERK.  Yeah - real candidates for parents of the year there.

The cop was actually MUCH more tolerant than he was required to be.  Regardless of what you believe WRT police overreaching, you are required to obey a lawful order.  IF the subsequent search turned out to be illegal - evidence gets tossed out.  Given his asshattery - he probably was mostly baked by that point.

Cop knew he was being recorded, and just kept being polite and instructing him on what to do.  They did not even freak at "mom".

Arguing the law is NEVER going to work in the street - follow instructions - document everything, then argue it out in court if you are wronged.

In a "Terry Stop-n-Frisk" you only have to identify yourself.  If he wasn't driving, he only had to tell the cops who he was.  Might well have been able to get outta there otherwise.

But if the cop says he smells weed, (even if he doesn't) it's his word against yours in court when he searches if he finds weed.

And the "castle doctrine" won't save you, nor will whatever attorney's name you happen to mention.

Are potheads really that clueless on how strong that smell is? Maybe I'm sensitive to that smell, but I can smell marijuana from a pretty good distance. Long story short is don't smoke pot in public or right before going  out unless you want the attention of police.

Without smell-o-vision there's no way to know who was in the right in that but the guy in the car seemed like a bit of a sovereign citizen douche and the cop was pretty restrained so if I had to bet, I'd bet the cop was in the right.

Smokers in general (doesn't matter what you smoke) have a reputation for having a bad sense of smell/taste.  As a smoker, I can tell you that after I've smoked I lose the ability to smell smoke for a while.  Or at least the smell is considerably lessened.

That wasn't a Terry frisk. You hear the girl saying "How about a warning and a ticket for the no seatbelt?" to which the cop replies "We were going to go down that path, but unfortunately..." The cop pulled them over for a violation (seatbelt). He smelled marijuana in the car. 

Plus, if the guy isn't a resident, how does he know who the attorney that represents 42 USC  § 1983 lawsuits are? I'd be willing to bet he's one of those "sovereign citizens" or some shiat.

I managed to acquire this video of the police violating the rights of this man and family! It's awful! Some highlights - the police Taze this guy several times just for asserting his rights - one cop gets in the backseat and kneels on the 3 year old! (later the boy said that the police man had hit him) - this man is a legal caregiver in Michigan, this traffic stop happened in Illinois, there was no marijuana in the car to be found

Yup. Since we can't smell anything through video, that right there is the pivotal question. If they didn't find any marijuana then the guy had every right to expect the cop to get a warrant for the search since in reality there was no probable cause - and the cop just wanted to teach a hippy "his place".

If they found marijuana, then there most likely was probable cause and the search was legal. The hippy should have complied. Wonder if we can find a follow up story which answers the "well, was there pot or not" question...

Reading the fundraiser it seems pretty clear that there was pot.  He's been arrested multiple times for possession.

Well, today is a little rough.  Jon is being charged in Cass with possesion and intent to deliver.  If we wantt to fight we are going to need way more that.  Should we fight?  The cost is so high.  Please share Jon link and our story.  Right now it isn't looking good we need support.
