A body cavity search is a form of rape.

LEO's use it more to punish, humiliate and control than anything else.

It use should be illegal or at the very least seriously curtailed.

Hope these ladies sue the hell out of these shiat-for-brains Texas cops and make their points heard.

FTFA: Turner later released both women and issued Miss Hamilton a citation fro possession of drug paraphernalia. She is still fighting the charges in court, though she contend the marijuana wasn't hers.

Did the cops plant the marijuana on them too?

mhmm

that being said, cavities are used to smuggle stuff all the time.
This case? RAPE. Plain and simple.

Good luck getting one cop to arrest another cop for rape.
I guess you could pressure the DA to arrest and charge the cops.
Oh wait, the DA's rarely ever do that.

I bet they had a little attitude, and the cops decided to teach them they should remain calm and be more respectful in the future.

What better way to do this, than snap on those rubber gloves and yell, "bend over and grab your ankles!"

Criminal charges against the cops won't change anything about their behavior. A nice, hefty civil judgment against the cops as individuals and against their department would have a beneficial effect. Taking their jobs and money and homes would send a nice message to future rapists.

Not sure if serious.  There's no reason to do a cavity search on the side of the road.  If the suspects won't produce the contraband on their own, just take them down to the jail and do the cavity search in private.  Then charge them with bringing drugs into the jail.  It's win-win for the cops.  I don't see any advantage to doing a strip search on the side of the road.  They don't get to add an extra charge and they run the risk of ending up in their current situation.  There's just no benefit.

Parts of it probably but if I remember that was filmed by bystanders and not by the in dash cam on the police car.

It's one thing to be caught on video doing something you shouldn't when you don't know you're being taped. It's quite another being caught on tape by the cam in your own farking car you are fully aware is there recording you doing some pretty heinous shiat. The latter is far far more stupid.

If it's the one I'm thinking of....(if not disregard)
Why do people keep spreading this one?  They bought and carried (carton) of lacroix(12 packs have the same shape as 12pack of beer, not the longer/thinner soda 12 packs, a 6 pack of bottles look like they could be wine coolers)
Cops(undercover stings for underage sales) approached and showed badges and scared the girls who were already in the vehicle, told her to roll down window, she started the car(power windows, doesn't know how to just turn the key to on apparently), cops started to yell, she got more scared, never rolled down the window and just fled, hitting two officers.
No actual stop as the girl disbelieved them, so obviously no frisking, no searching, no demonstrable illegal behavior on the part of the cops, nothing.  Supposedly guns were drawn, but that could have come after the car was started suddenly.(articles sourced to date tell the story out of order with obvious slant).

That's not actually what the article says. It says there was a used blunt "under the back seat" which is neither in plain view nor readily accessible from the front seat.

Even if the situation you describe existed I'm not sure how "signs of previous drug use" leads logically to a side-of-the-road cavity search. Do people who previously used drugs often hide something that poses an eminent threat to the officers in their body cavities? Do people who have previously used drugs have the ability to destroy evidence simply by holding it in a body cavity for a while? If not, why the urgency?

I personally know a lot of cops. 100+, at least. While that's a very broad and demeaning statement you made, I find that I can't argue with it. Out of those 100+, of the top of my head I can think of only one (a police chief, if it matters) where I'm certain and maybe 4-ish (one DPS and the rest SO) where I'm kinda sorta sure that they don't fit that description.

Same as the military in general(science/technology rich air force aside, which is what I did).  Too much actual work for smart people, too much risk for smart people, and not enough pay.  Maybe if these jobs paid better and/or promoted/hired based on merit/skills instead of the only promote from within based on seniority.

The way the system is currently set up, you've got to be either:
A. Desperate.  It's stable money and they'll take just about anyone.
B. Devoted to purpose.  Sort of a rare zealotic bird, especially for cops because corruption tends to spread.
C. Aggressive.  The job comes with power and it's own "perks".

A lot of cross over between A and B of course, and between A and C, but I think you get the general idea.  Doesn't help matters that they're under a microscope of everyone, breeds animosity in a self sustaining cycle.

It's like the priesthood and teaching.  It's one of those jobs where you have to be a little bit off in one way or another.  An obvious choice for anyone in the C, the one's seeking the job to pursue another agenda.(kiddy diddling for the other two, still "power" positions(met some mean ass teachers in my day, and catholicism is full of fire and brimstone punishment as well))

Nothing wrong with that per se, but it could use a lot of tuning to weed out the bad ones for fear of getting caught.  We live in a society where personal responsibility is at a very very low to non-existent concept.

It's never our fault.  Never.  That is a society wide flaw, this is just how it manifests in those jobs.  Corporations get bail outs, able bodied people live for decades on welfare, the RIAA with it's roots in organized crime seek to make (infinity) money from single performances...of other people.(and convinced a large part of the populace that it's legitimate).  I could go on, but I think I'm about sick from thinking about it too much.

So, I'm going to go take a smoke break and maybe play angry birds until I forget about it, and thereby contribute to the problem like 99.9% of the "civilized" world does, and then look up in dismay when something else bad happens and think, "Who was stupid enough to let that go on?!?"

Even though I know the answer is "all of us", it will continue to amaze me.

In the King case, they weren't on dashcam. These morons didn't even have that excuse. What these guys thought is that these two ho-hos would not take it all the way to court, that they'd be too embarassed and/or intimidated to make it public. And they were wrong. Obviously, or they would have erased the tapes when they got back to HQ, as I bet they wish they did now, and it's too late. HA HA.

Here's hoping they get exactly what's coming to them.

Articles I've seen claimed they approached with guns drawn, in plain clothes, and did not show badges.

Source?
She openly admits to seeing the badges, calls them "unidentifiable."...  In the several I've seen, including the one that made fark.

As I noted, the articles may be somewhat questionable in the order of events, many jump around in the sequence.  Anyhow, she spent a night in jail when they caught up with her.  Lucky the DA or whoever dropped all the multiple felony charges.

Regardless, that case is irrelevant here.  She was never stopped or frisked, and it's not Minority Report, so no pre-cogs.

Can a court say that if a police officer wants a bra shaken out, a look below the waistline, or a good look inside a personal orifice, then it has to be done inside controlled facilities.

It cannot be done in the field.  Anyone cop doing this in the field will go to jail and loose their job.

Cause they usually count on the tapes being "corrupted" or "unreadable" right after the point where the perp does whatever they did to get the cops attention.

Or sometimes the judge refuses to look at the damning evidence because the other officers on the scene refused to authenticate it and claimed it differed from their recollection:

Waistbands, pockets, bras( the wearer shaking it out with our actually revealing anything, imo, is fine), and a general out of garment pat down always need to be done for weaponry in the case of an arrestable offense, in my opinion. (not simple speeding/littering, etc)

Cavity/strip searches can wait until processing at the station.

This. From what I understand, cavity searches in the field violate about 10 different laws and regulations. They're a one-way ticket to firing and PMITA prison time. Perhaps it will do the authoritarian douches involved in this case some good.

Texas, you just bought each of these women a new house. Each.

When I told my sis in law (an RN for over 15 years) about the part where the female cop stuck her fingers in these women's hoo-has using the same pair of gloves, her eyes got huge. That is a BIG no no, and can transmit all kinds of disease from yeast infections to chlamydia to genital warts to HPV and HIV/AIDS. She sometimes changes gloves up to three or four times per patient as she examines them.

This is why it should be a FEDERAL law that ALL police/SBI/FBI/etc. must be REQUIRED to have a helmetcam/shouldercam/etc. turned on the ENTIRE time they are on duty, being turned off only when they have to go to the restroom.

I'm not from Texas, so there isn't much I can really do about this.  The problem is that a large portion of the voting public is composed of idiots who probably think there was nothing wrong with what happened.

Allegedly a quote from one of the heads of what would be later known as the DEA is pretty much "It makes n**gers think they're equal to white folk".  So yeah you're pretty much on the nail.

Which is kinda sad when you think about it.  All the research time and money in to a drug that it now turns out is the dream pain reliever (not physically addictive, no major side effects, no resistance build up) and mood stabiliser (a lot of bi-polars have ditched their meds in favor of occasional mj and seem happier, more balanced people because of it) that wasn't spent because some racist numb nuts all those years ago didn't want blacks thinking they were the equal of whites.

Quite a few of these guys were TOO STUPID TO ENLIST!

Let that sink in.

And quite a few former MPs cannot get hired by civilian departments because--and I quote, "they are not flexible enough with the rules." Meaning, in the words of one MP I know who was turned down, "I wasn't willing to overlook other cops doing shiat they shouldn't have been." This was AFTER the GITMO shiat that went down, BTW.

Let THAT sink in.

Lsherm: Freak: Didn't something like this just happen with some other cops searching another pair of women by the side of the road? That was all over the news too, you would think these cops might have learned a thing from it.

Yeah, and those two idiots (the cops) were brought up on criminal charges.  The female cop may have to register as a sex offender if she's convicted.  If you watch the video linked in the article, not only did the female cop not change gloves, she fingered their assholes first and THEN checked their vaginas, which is just inexcusable.

I saw nothing about anal penetration. If she really didn't change gloves, that's a serious farking STD risk (most likely aids).

Texas, you done farked up now.

Aigoo: This isn't the taxpayers' responsibility--it's those officers' and their agency's.

Everything else I agree with, but that quote, if nothing else it's misleading. You were in the service and don't grasp the concept of "freedom is not free"?

In a government of, by, and for the people, the people gave them the responsibility. It is the citizen's duty to police those above them. Our government, to include law enforcement, is not benevolent, not to be trusted or worshipped.  When it fails, and it has, does, and will always, it falls to us to repair it.

Power corrupts.   This is why we have representatives and senators and their like, the ability to protest and campaign for change, and even the ability to revolt, should it come to that.

Our forefathers knew all of that.  They understood the balance of power needed to stave off tyranny.  That is why we have the right to bear arms, and all of the options listed above, and I'm sure more that I cannot think of at the moment.

Yes, if they falter they need to be taken to task.  The only party that can do that is citizens themselves, by voice or by muscle.  They work for us, not the other way around.  They were not meant to be the nanny or father figure that people have allowed them to become.  Society itself has faltered in that regard. It is/was our responsibility, whether we like it or not.  Pretending otherwise is an exercise in rationalizing laziness.

Well, yes.

Smart people generally don't become cops.  Mouth-breathing farktards who would never be trusted with an ounce of authority in any other situation become cops.

They all, of course, think they're among the smartest and most trustworthy people to grace the planet, and all but those noted have the stereotypical 'holier than thou - obey mah authoriteh' attitude when interacting with the non-LEO public.

"The world needs ditchdiggers, too."

I know 2 cops well, and one I would describe as quite smart, and the other (former intern) as holy-hell-please-work-for-me smart. Both college educated. Both are respectful, thoughtful, and low-key. Then again, in Northern Virginia we pay our cops pretty well, so we get good candidates vying for jobs. I found the same thing to be true of our firefighters (I knew a lot more of them). Good pay equals good candidates.

MFAWG: To be fair, it turns out that the kid took a shot at the cop in question. That makes it understandable as to why he wouldn't be getting much sympathy around the courthouse.

Perhaps, but the cop should, at the least, no longer be a cop.  There are standards to be met.  Once the kid's in custody the proper forum is the court.

My point remains:  Behavior such as that tends to expand over time.  It's why I say it's more about bad departments - they don't fix/eliminate bad starting cops, who become badder slightly older cops.  Next thing you know they're executing people in the streets.

I've got a better question?  Why would they do that AT ALL?!
The idea that the tape should keep them in check is actually backwards.  It's like saying, "I won't shoplift because of the surveillance cameras", instead of, "I won't shoplift because it's wrong."

The cameras should be in their badges - doesn't turn off when in the bathroom because the cops own genetalia is outside the vieweing angle of the badge-cam.  Badge to remain visible at all times, video uploaded to secure offsite location, maintained by civilians.

Well no.  You don't have the right to stop routine police procedure (booking, searches, etc) until you have a lawyer present.  Your right to a lawyer applies to interrogation while in custody.  It would have no bearing on this case, and a request for one wouldn't cause the police to stop their investigation, nor would they be legally required to provide one.

There is a time and a place for a cavity search of a person.  I won't comment on whether it was appropriate in this case to perform a cavity search.  I will say that the PLACE for the cavity search is NOT on the side of the roadway, unless you feel that the person is concealing a weapon or something along those lines.  In that case, an amublance should be summoned to the scene for the purpose of getting the person out of the view of the public and some measure of privacy.

Our jail will do cavity searches, but they're limited to the situation at hand, and must be approved by the jail supervisor on duty.  In those cases, they're performed by the jail nurse on duty, and while video taped, not done in the presence of anyone who doesn't need to be there for the examination or change of custody of the evidence.

I fully support the termination of the officer who performed the roadside cavity search, and quite possibly the other one.  He was speaking and acting completely unprofessionally.

I'd support that, but you'd never get the charges to stick.  You're lacking the "criminal mind" element of the crimes, and as for sex crimes, most every single one requires the offender to be doing it to satisfy their own sexual urges.  There's no way you can argue that with a cavity search on the side of the road.

Well I am pretty sure indecent exposure have been applied to people mooning or pissing in a bush. Quite possibly that has at least in some cases got on them on the sex offender index. Last time I checked mooning or urinating wasn't about sex.

And last time I checked rape wasn't about common sexual urges, but about getting off through forcing yourself on other people against their will. I would argue that perfectly defines sexual assault.

Cops love to throw around changes anyway, too often they don't fit whatsoever. Sexual assault actually applies to these yahoos.
