I believe we have turned the bottle upside down and begun shaking it.

In other news, the judge has decided that adhering to the schedule overrules reading case law to make an argument against the prosecution's motion.

I wonder if it's a reversible error.

I mean, it just seems like that the prosecution *AND* the judge are dead set against making a serious case against Zimmerman.

The judge actually seems bent on helping the prosecution throw whatever shiat they can find at the wall and see if anything sticks. She's already said that the 'evidence' doesn't have to relate to any specific fact in order to be allowed in - just has to vaguely support whatever theories the prosecution may wish to present.

Not even letting an attorney get his motion on the record before interrupting him and denying it sure bolstered her impartiality as well.

They should have the judge I did when I had jury duty here in "special" Central Florida.  Fraud against the state.  Should have (and could have) taken 5 days max.  Ended up being 14 twelve hour days.  We were effectively sequestered.  The State had a tremendous case against the guy and we still had to read every single piece of paper they had in evidence.

I was foreman and had to pause during deliberations because I was afraid we were going too fast.  Guilty, guilty, guilty (14 counts)...with barely any discussion.  I wanted to make sure we were doing our job, but after the case the prosecution presented there really wasn't anything left to say.

Yeah, I'm still trying to figure out how GZ's schooling and his not getting hired on as a police officer due to credit reasons is relevant to this case.

It's almost as if she's deliberately laying an enormous foundation to have a guilty verdict thrown out.

I think if you're trying a murder case, a just and fair trial should be the most important thing, no? Sequestration is hard on the jury, but so is going to prison when you're not guilty of a crime.

It's smart of the defense attorney though. He's preempting the prosecution's intent to contend that Zimmerman learned about the 'Stand Your Ground Law' in Carter's class and thus was lying to Hannity during the interview on Fox News by getting the instructor to demonstrate that what he taught was an extension of castle doctrine that shifts the presumption of harm to places outside the home, but not that he ever stated its name as 'Stand Your Ground Law' because it isn't named that.

How is lying to Hannity even relevant?
Was he under oath while on Fox?
What does his knowledge, or lack thereof, of the removal of the duty to retreat provision in the self defense law have to do with anything when it's claimed, and proven, he was underneath someone with no reasonable means of retreat in the first place?

Sweet jumpin jesus they just said in testimony that even if you initiate the situation you can be put on the defensive if response is disproportionate.
It's almost like the people in these threads actually reading the law knew what they were talking about..

I have to say that the judge's decision to let a criminal justice professor testify is one of the dumbest things I have seen in a trial, perhaps ever.  The prosecution just opened the door to have a witness lecture the jury on the law and it's the judge's job to instruct the jury on the law.  She should have denied the state's request to let this witness testify.  Granted, from what I have seen thus far, her decision to allow it fits perfectly with her pattern of rulings in this case.

It's really not, and no he wasn't, but the prosecution already got that in and prepared to make the argument that he's a liar. It makes sense for the defense to preempt that by having the prosecution's witness bolster what Zimmerman told Hannity rather than undercut it.

The problem is, irrelevant or not, this is in front of the jury (and the judge already ruled it admissible) so the defense is doing what they can to use it in their favor rather than the way the prosecution wants to spin it. They seized control of Carter's testimony and got him on record saying he never taught that there was a law called 'Stand Your Ground.'

Lawyers like to tell an old joke that goes: Ten years after graduation, what do you call the person who graduated number one in your law school class? "Professor." And ten years later, what do you call the person who graduated right in the middle of the class? "Partner." And what do you call the person who graduated dead last? "Your Honor."

Chewbacca Prosecution?

2013-07-03 10:49:29 AM
I'm gonna need a recap so far. Been far too busy between work, sidework and volunteer stuff to keep up with it all.

A guy I work with (who believes Trayvon was nothing but a drug addled gangsta thug... why yes, my co-worker is a Republican..) thinks Zimmerman's lawyer is destroying the prosecution and that the prosecutions witnesses are doing nothing but corroborating the defenses stance that Trayvon was the aggressor and 'deserved to get shot' (my co-workers words, not mine).

Any truth to any of this?

2013-07-03 10:49:34 AM
It was going for the prosecution until the aliens came down and killed everyone.
