Although in this day and age, i can see them taking seriously a "terroristic threat", them investigating and finding no evidence of intent beyond a douchbag comment, they should have just fined him, or given him community service.  Jail time, no matter how much of a jackass he was for making the comment, is a bit harsh.  Esp a year.  Now, if they had found a ninja outfit, AR-15, and tons of ammo, plans of a school, yes...jail time.  But this is not unlike arresting someone and jailing them for a "thought crime".  If i say I'm going to rob a bank, will i get arrested and thrown in prison for a comment?  Just wondering how much this new "slippery slope" goes.

Plenty of teenagers on Xbox live think it is ok to say they are going to have forced sexual relations with me, my mother, or sometimes my grandmother. While annoying I don't think they should be thrown in jail for it.

Well, you've got your first guys in jail. The originals. They weren't raping at first, but they eventually started raping each other according to size and  ease of access. Then the new guys showed up and the originals were all like, "let's just start raping the new guys!" they voted and a majority passed.

The woman that contacted the police was Canadian. I've been reading about this since it happened.

The kids were trash talking, one of the other kids said something about how the "criminal" was acting crazy and his response was to post something on FB. He and the kid were friends on FB. In earlier stories his FB comment was clearly related to the conversation from the online game.

He's an idiot, but being an idiot is still legal most of the time.

After putting you in solitary. So you can't hang yourself or choke yourself by ingesting them. People have gotten really creative in ways to themselves in jail.

I really want to know how law enforcement can determine he intended any of those things.  I don't think he expected a reaction from the police, so we can rule #1 out.  After investigating and finding no plans, means, or intent to actually place anyone in danger, and given the context of his comments we can rule #2, #3, #4 and #5 out.  Since this was not a political statement aimed at influencing any governmental entity, we can rule #6 out.

It's a slippery slope.

On one hand, he doesn't seem to have access to weapons; apparently didn't make any plans to carry out such an attack; and generally it just seems to be a dumb teenager's online rant.
On the other hand, with the relatively recent mass school shootings around the country, if they hadn't arrested the kid and he HAD done something, the media/public outrage would have shaken the public safety and judicial systems enough that there would have been mass firings or someone in a position of authority would have been scapegoated and crucified.
All the same, the imprisonment and ridiculously high bail are reactionary, unnecessary, and unwarranted. The kid is in the system now and house arrest while awaiting trial should surely be sufficient. There is no reason to destroy this boy's life over what is highly likely to be just a kid writing stupid things on the Internet.
If the kid DID write "jk" after his little rant and the prosecutor is choosing to belittle or ignore the significance of such a disclaimer, then it's just another asswipe lawyer trying to make a name for himself.
Kids say stupid things all the time, and in my opinion, he should be psych evaluated, his friends and family should be interviewed, and he should just be released if common sense dictates that there was never any real threat.
But shucks, this is TX. We love locking people up here, especially if we get to execute them

None of this has been proven. That's what the trial is for. He was arrested because he was suspected of having done this. He's still in jail because his bond is set at an amount most accused rapists, murderers, or arsonists don't even see, and his parents can't come up with the scratch to get out. So he gets beaten up and raped until his trial, which could be set for early next year.

Pure hilarity.  They are going to end up paying him millions in a settlement for all of this roughhousing and heavy handed justice.  This is just kinda sad.  As always the main idea should be context and intent.  And besides, I see waaaay worse stuff posted online on a daily basis.  Why not hang out at theync.com or worldstarhiphop.com or hell, youtube (if you can read spanish).  Hope everyone comes out of this with a heaping dose of common sense.  It already sounds like little Billy has probably learned his lesson.  He will quickly forget that lesson when he has 3.5 mil in his pocket after the settlement.  He can buy all of the wonderful things you don't want him to have ;)  This is why we need to bring back Yo Momma insults.

This does sound a bit excessive, but somehow the vast majority of people manage to live long lives without making threats to shoot up a school.

Parents need to beat it into their idiot kids that they need to watch what they say, that stupid talk can have really negative consequences. There are things which are never to be said, even in jest.

Maybe this kid is getting beat up in jail because he's an annoying whiny douche.

I'm torn.  I hear and read all sorts of shiat while gaming but they usually are not "I will kill a schoolroom full of children," and it is usually kept in game where there is a certain amount of tolerance for that behavior, not on facebook.  He should get off when he gets to court.  Is bail too high? Yes, most likely it is, but welcome to the justice system. Don't specifically threaten mass murder of children, especially after how many school shootings?

However, I really can't muster one ounce of sympathy for this colossal shiathead.  Anyone of legal age who cannot put together cause and effect at this stage of life deserves a severe lesson in reality.  Want to threaten the death of children?  Guess what? You go where the other child killers are.

On one hand, he doesn't seem to have access to weapons; apparently didn't make any plans to carry out such an attack; and generally it just seems to be a dumb teenager's online rant.
On the other hand, with the relatively recent mass school shootings around the country, if they hadn't arrested the kid and he HAD done something, the media/public outrage would have shaken the public safety and judicial systems enough that there would have been mass firings or someone in a position of authority would have been scapegoated and crucified.
All the same, the imprisonment and ridiculously high bail are reactionary, unnecessary, and unwarranted. The kid is in the system now and house arrest while awaiting trial should surely be sufficient. There is no reason to destroy this boy's life over what is highly likely to be just a kid writing stupid things on the Internet.
If the kid DID write "jk" after his little rant and the prosecutor is choosing to belittle or ignore the significance of such a disclaimer, then it's just another asswipe lawyer trying to make a name for himself.
Kids say stupid things all the time, and in my opinion, he should be psych evaluated, his friends and family should be interviewed, and he should just be released if common sense dictates that there was never any real threat.
But shucks, this is TX. We love locking people up here, especially if we get to execute them

You don't follow any logic. A TV show about a serial killer has no bearing on whether or not an individual who is not an actor, producer, TV show writer, or viewer of said TV show made what sounded like a threat on a public forum. Kids say stupid things. Adults say stupid things. I've said stupid things (reams of them). I've never said something so obscene or disgusting in my life. Kids planning to do horrible stuff happens all the time. In some cases, like the Boston Bombings or Sandy Hook, they actually carry out these threats.

Personally, I think he crossed the line. If what he said wasn't a threat, it was at the very least obscene. I think it would be sufficient to let someone know when they've crossed the line. I don't agree with the manner in which police and the judicial system felt it necessary to excessively punish the person, nor do I think I would ever want to live in Texas because the prison system there is so terrible. A night in jail? Meh. I'm not even sure that's necessary, especially in Texas. A strict talking to by a police officer? I think that's warranted. Sometimes kids need lessons to curb their judgment.

This is absolutely unbelievable. We have completely lost our farking minds in this country. Is the kid an idiot? Yes. Shouldn't he know better in a post 9/11 world? Yes. Should he be placed in jail as a terrorist, given a bail so high his family could never afford to pay it, and spend months being abused and put in solitary as a result of him being 'depressed'? NO. In other news, how could the kid possibly NOT be depressed? He made a stupid comment online and is now being treated like a resident of Syria!

What has happened to my country? In thinking back to when I was a kid and all the crazy shiat we drew on paper and said to each other, I think most every boy I knew growing up in the 70's and 80's would be a 'terrorist' by today's standards. I suppose this is what we get for letting the government prey on fear to get something like the 'Patriot Act' passed through Congress without mass public outcry.

So let me get this straight... This asshat plays a game, leaves the game, posts a comment where most likely anyone can read it (teenagers like having hundreds of "friends" on Facebook and are notoriously bad at privacy settings) without referencing the game and threatens to murder a group of 5 year olds, and I am the idiot who needs a lesson in context? Need I remind you how many times Facebook has been used as evidence in any number of criminal investigations or the fact that if there is a hot button in law enforcement these days it is probably the mass murder of children?

Context is everything (or should be) in cases involving threats.  If there is a reason to believe that the threat is realistic then it should be prosecuted.  If no rational person would feel afraid of the threat (telling someone on the other side of a 1,000 foot wide river that you're going to throw a rock at them) then it's not criminal.

If the threat wasn't reasonably likely to be carried out, then the most they should have done is yelled at him, maybe arrested him, then let him go.  Prison space is waaaaay to valuable to waste on internet-yelling.

Plissken: It's a slippery slope.

On one hand, he doesn't seem to have access to weapons; apparently didn't make any plans to carry out such an attack; and generally it just seems to be a dumb teenager's online rant.
On the other hand, with the relatively recent mass school shootings around the country, if they hadn't arrested the kid and he HAD done something, the media/public outrage would have shaken the public safety and judicial systems enough that there would have been mass firings or someone in a position of authority would have been scapegoated and crucified.
All the same, the imprisonment and ridiculously high bail are reactionary, unnecessary, and unwarranted. The kid is in the system now and house arrest while awaiting trial should surely be sufficient. There is no reason to destroy this boy's life over what is highly likely to be just a kid writing stupid things on the Internet.
If the kid DID write "jk" after his little rant and the prosecutor is choosing to belittle or ignore the significance of such a disclaimer, then it's just another asswipe lawyer trying to make a name for himself.
Kids say stupid things all the time, and in my opinion, he should be psych evaluated, his friends and family should be interviewed, and he should just be released if common sense dictates that there was never any real threat.
But shucks, this is TX. We love locking people up here, especially if we get to execute them


I totally agree with you. Getting beaten up in jail is probably just another example of how clueless and socially awkward this kid is. Given Texas' track record with inmates, I'm sure he'll be rehabilitated in short order.

That kid reminds me of this kid I saw on Lockup MSNBC. This poor bastard was the biggest nerd I ever saw and suffice to say he did not do well in jail. After getting beat up for the 2nd/3rd time the prison put him in solitary. When it came time for his review to get back in to population, the voice over was saying things like "the staff is amazed at how naive he is" and "the staff has grave concerns about his ability to deal with the other inmates". He thought "once the guys got to know him a little better they would like him". Seriously. I wonder where he is now?

I heard the interview on NPR this morning. It's ridiculous the parents are blaming the Internet "subculture" regarding trash-talking.

What says more about this case is the kid is 19, living at home, and appears to be socially immature for his age. Since it's Texas of course they threw him in prison. Therapy and community service would have been the best option for this kid so he can understand the differences between threatening to kill children and teabagging your mom.

That's pretty messed up.  I think the kid just made some poorly thought out angry remarks.  I don't think he was serious.  I do think prison should be a form of punishment, but he hasn't even gone to trial yet let alone been convicted and even so, beatings by other prisoners falls outside of the scope of sentencing and should be considered cruel and unusual.  If prison officials cannot ensure the safety of prisoners, there's something seriously wrong.

He's probably a pretty normal kid and sending him to prison isn't keeping anyone safe or doing him any good.  I would release him and maybe send him to a shrink who could probably confirm that he just said some off the cuff shiat.

Where are the prison/jail guards? I'm guessing the answer is they're not there because it's more profitable to run a prison on a guard deficit, but I'm hoping I'm wrong.
