Also: Most agencies use tests that are even less stringent that federal tests, and won't detect anything after two weeks. That said, I went to an interview for an automotive dealership for a mechanic's position, got asked to take a drug test. Told the manager up front what I'd test positive for and what I wouldn't. Manager said, "Don't really mind the MJ, just no crack, meth, the harder stuff." I assured him that he wouldn't find any, and that I would stop the MJ when I got hired. Started my first day a week after testing dirty.

Since then, whenever someone says zomg drug test!, I laugh. Honesty will generally get you a lot further than a drug test, regardless of what you're doing. The drug test was just the opportunity to prove to the manager he could trust me, something a lot of "addicts" (and even most employees) can't claim.

Worth noting that the ACLU took this case.  Given the cost of litigating against governmental entities, but for the ACLU the mother would have had to either shell out for a good lawyer or try to find a PI lawyer willing to take a relatively small contingency case against the State.  Too often the ACLU provides the stop gap remedy for equal access to the American legal system.

Nice work ACLU.

I see muffin abusers all the time downtown. They find some dark alley, light their candle, and start clarifying small packets of butter they steal from Tim Hortons. They then spend the next hour scarfing down 10 to 15 poppy seed muffins, washed down with bottle of mint flavor Scope or, if they panhandled a couple of extra bucks, Aqua Velva Ice Sport vintage 2011. Sad.

Why the FARK was this woman even given a drug test. I've worked in hospitals for years and have never heard of such monkey shiat. Did she request said test? I doubt that seriously. Who in their right farking mind goes into a L&D unit and says, "Hey, would you screen me for drugs while I'm delivering this kid?" Oh wait, I guess said medical facility can BILL insurance company or patient for "Misc. labs" or "Urine tox screen" and figures it will fly under the radar. The fact she won this suit makes me very farking happy. Gawdamnitsofarkingmuch!

I'm not sure what country you've been living in, but most Americans are extremely authoritarian. We love electing authoritarian jackasses to dream up new laws and ways to punish us and then eagerly anticipate ways to get each other in trouble over the malarkey. Add in a  misplaced sense of justice (well, it's actually more vengeance or moralizing over punishing "evil doers" than justice) and you've got modern day America.

Of course, to be fair it's just not the States (I've lived in enough countries to have seen this behavior before) but we do it pretty damn good compared to most first world nations and probably better than some third world ones. I tend to think it's some sort of tribal social behavior left over from when we needed to have tight uniformity and control over social groups for survival. But who knows, maybe the truth is that most of us are just assholes?

Here in PA it's because of farkwads like my cousin and his useless ex wife/baby momma. She's a junkie, been told to stop having kids after the first crack baby, but guess how many addicted babies she's had?

She finally got her tubes tied, but the damage is done. She's currently behind bars and will be there for awhile. My cousin's also in jail. Those poor kids are stuck with her psycho parents and everyone is a loser here.

Some hospitals (states?) conduct drug tests at all births as a matter of course, regardless of any drug history on the part of the mother.  One false positive and CPS has your kid before you can squirt out your first ounce of colostrum.

I have the J. Peterman baseball glove leather wallet.  Pretty expensive initial cost but it's about 10 years old now with zero signs of wear and, as advertised, it improved with age.  I really recommend it.

I had to take one because I got hurt at work. Surprised the utter shiat out of me when it was negative because I was extremely aware I'd smoked the night before.

I'm glad I don't have kids.  I'd be the guy getting shot for beating a CPS person.  Especially if I was innocent.   I don't see why people let others come steal their kids because they're being accused wrongly of some sin.   fark that shiat.

So hospitals are drug testing mothers that go in to give birth and then the ones who fail have their kids taken away from them? Really? That is really farking insane, I hope there's more to this story than we know because that's outrageous, even if she was doing opiates.

Sadly the CPS idiocrats involved will get to keep their jobs, and the settlement will be paid out from insurance. We need a few dozen CPS people to come within seconds of being shot for taking kids in situations like this before they'll clean up their lazy checks and processes, out of fear if nothing else.

Eh, I don't really care. It's a CYA thing, so I don't take it personal. And especially since I was taking a position as a mechanic? I wouldn't want my mechanic high on the job (and no, I never was).

But I'm not seeking traditional employment anymore, anyway, so it's a moot point for me.

Nope, it was standard policy at the time for Jameson Health System to routinely test pregnant women for drugs. They also failed to take into consideration that she ate something before the test which triggered a false positive.
