A better answer is that a prosecutor was involved. His only job is to send people to prison. He doesn't have to be right and there are rarely consequences for being wrong even if he gets an innocent person killed, but his political opportunities open up more and more before him the "tougher on crime" he is.

Thank God for this. It's bad enough that you come home to such a tragic situation and lose your daughter, but to go to prison for something that did not happen is really wrong.

I want to say I am happy for the man, but shiat, he lost his daughter and I am sad for him.

Whether or not I find Flo hot, what hasn't been determined yet is what will happen when Progressive is asked for records by a prosecutor in an effort to convict a Progressive customer.

Let's hope that the 4th and 5th amendments are strong enough to deal with that situation.

 I am going to go with that one. I have seldom if ever heard of any trial of a black man charged with crimes of violence -not- putting the burden of proving innocence on the defendant.
 The case sounds like; 1) it should never have gone to trial, and 2) he would have been convicted had he not proven his own innocence.

Wow, that does sound horrible, and I'm fortunate to have never heard one of her radio ads. Whenever I see her on TV, I immediately change the channel, hoping that my small, inconsequential act of defiance will get her banished forever. Of course this will never happen, but at least I tried.

It's not smart enough to know you're in a 25 and ding you for going 45, but they'll probably get you if you're doing 120.  It's mainly about how much you're driving and what times of day you're driving.

It's nice to see them get someone off who was not guilty.  Last time they intervened in a fatality case it was on behalf of the guilty party whose own insurance company admitted his guilt and paid the victim's claim.  The victim had Progressive and by law had to take the driver who was at fault to court and civilly win the case for Progressive to pay out.  Will Wheaton was instrumental in publicizing that abortion of justice. Here's a review of the facts of the case and how they were trying to weasel out of it.

I thought the same thing, but I read the fine print and it's not gps enabled or anything and you only use it for 6 months and send it back. With me, the potential to save a hundred bucks or so is worth it since I'm a pretty laid back driver anyway.
