Why not?  He was the last man back, Neymar had clearly beaten him in a goal scoring position.  Pique's foot was elevated past where the ball would have been if it was on the ground at his foot.  He not only took away a goal scoring opportunity (at that point, with pique beat, Jo and Neymar were in 2 on 1), but it was also violent conduct.
