This is an old trick.

Remember that drunk driver in Florida who adopted his girlfriend? We had a thread about the appeals court decision voiding adoption for lack of notice to interested parties. One of the judges would have disallowed the adoption because you can't adopt your girlfriend. He cited with approval an old New York case that was about gay adoption.

If they own the property as Joint-Tenants the property goes to the surviving partner.  No taxes, no muss, no fuss.

It's only an issue if they own the property as tenants in common and if they do that can be fixed quickly enough.

The same can apply to various accounts as long as they are joint account holders.

So this is a case of "I don't want to actually share property with him while alive, but I want it to go to him free if he dies."

My family raised an orphan from a foster home we met when he was in high school with my sister.  Now that my parents are in that time of life where they are thinking about what they are leaving behind, why shouldn't they be be to officially adopt him so that he will be considered in matters of estate?

That's just one example.

don't know how but saw a TV show (Dr.Phil-ish type of show) where a woman had adopted an adult male who she thought the world of and it was messing up the family because he used to date the ladies daughter. Mom thought the sun rose and set on this guy and bitter daughter thought the guy was trying to wrangle something from the Mom, but it wasn't a family with money or what have you; the guy had nothing to gain. strange little episode it was.

Just because it avoids going to probate court doesn't mean that it doesn't count under the unified gift/inheritance tax system.  After my dad died, my mom made her house joint-tenany with me (so I wouldn't have to probate it later).  I had to report half the value of the house as a gift at that time, and the other half as inheritance when she died (of course, I was several digits short of worrying about any inheritance tax).

I'm not sure it's that simple.

Property owned jointly between husband and wife is exempt from inheritance tax.

Why don't they just register as a corporation, or specially a 501(c)4. Then they won't have to pay taxes, reveal donors, or pay housekeepers a living wage.

Of course, if they ever need to make any changes they'll find themselves in an IRS waiting room filled with Tea Partiers, whining Tea Partiers handing out Republican candidate flyers, and talking incessantly about being victims

If my wife dies before me I plan on marrying my son. That way the tax burden is much less. No incest applies as there cac be no offspring as that is why invest laws were written. And I can now marry my pet goat. In fact my herd of pet goats. Polygamy YES!

They could. But if either one of them DIES in Pennsylvania, the state will not recognize their marriage for survivor's benefits.

That was the whole impetus behind DOMA getting repealed, except that applied to federal benefits. The surviving lesbian of a married couple had to pay a huge extra inheritance tax because she couldn't pass along her assets to her lawful spouse?

These guys obviously don't want to be the next "test case" at the state level.

Back in the day, some friends and I had read The Harrad Experiment and thought as how a group marriage would be a fine thing...except how could one make it 'legal'?
The answer was 'we could incorporate'.

Oh, I understand that. Thats why I said they should move. PN and NY share a border- move to NY, visit PA. PA survivors benefit rules would have zero eefect on them if they are NY residents. Unless I am completely wrong .
