Aggravated assault for cutting a guy's neck?  Whether he was the guy with the knife or not, it's part of the attack.  Should be attempted murder.

A few months back my buddy was attacked walking home late. Two guys stabbed him, he fought them off. Cops came, took him to the hospital. An hour or so later one of the attackers checked in for a broken rib. Police apprehended the guy immediately.

Police let him go after 48 hours due to "overcrowding."

I'm a chaplain in a trauma center.  You'd be amazed at how often this happens.  The fun occurs when the family members meet each other in the waiting room.

The guy that got arrested isn't the one who had the knife.

So they dropped all charges or was he released pending trial?

I bet the double negatives fly like snow in a blizzard.

He was released pending trial, but they said it could take up to a year, and this guy was homeless vagrant who likely skipped town later that day. The officer that contacted my buddy essentially said, "well, he probably won't be coming back to this area for a while!"

Yeah, real reassuring.

I'm assuming your friend was attacked in a large city. I'm originally from West Virginia and no matter what you're arrested for if you can't afford bail you're stuck in a privatized cell for the duration.

I may have told this story before, but...

When I was in college, I had a summer job for a couple of summers working in maintenance at Sarasota Memorial Hospital.  As I arrived at work early one morning, there were still cops and reporters milling about near the ER..  It turned out that just before 2 AM closing time, a couple of guys got into a knife fight in a local bar and one guy got cut up pretty bad.  His friends got him out of there and to the ER.

As the doctors were treating him/sewing him up, the other guy from the knife fight showed up.  With a gun.  He went from treatment room to treatment room until he found the  guy he had earlier cut up, elbowed his way in past the doctors and shot the guy dead, right there on the gurney, and ran out.

Unfortunately, he ran out the wrong way, going further into the hospital instead of out.  Cops gave chase and captured him.  Anyway, three or four hours later, when I arrived at work, the place was still all aflutter.
