I'd say that when a justice gets as close as Scalia did yesterday to arguing against Marbury v. Madison, it's time to retire. I mean, dude attacked a cite from the majority opinion that was directly quoting Marbury. That's undermining the very foundation of the American judicial system for the last 210 years, and all because he doesn't like gay marriage.
