No no no.  He was drinking a Monster while driving.  He dropped the can on his lap, causing him to swerve and hit a tree.  Hence, it was Monster's fault for him getting into the accident.

Pretty cut and dry lawsuit.

That's funny, the last can I saw had a limit of one a day.  Was it revised downward or is the recommendation different in the US versus Canada?

That right there can and will be used against her in the court assuming this goes in front of a judge. They have a warning label and it is clearly visible. The only stupid argument against that is it does not tell you to see a Doctor before drinking.

/partly serious.. partly joking. You pick which is which.

Actually, it could be used against Monster since it says you can drink 3 a day and the claim is the child drank 2 a day (pretty interesting the lawsuit states a number under what the can said as opposed to a number like 4 - as that would imply the kid would be at fault)

Surprisingly, not as awful as I thought, though 4 servings of this a day probably meant that the kid had a higher than normal daily intake of sodium and carbs.

The stuff makes me shiat blood if I drink too much. I actually love the taste of the green ones. Would love if I could get the flavor without the extra caffeine or supplements in it. shiatting blood is cooler than you think btw.

At my old job Hollywood energy drinks used to be a sponser so they would dump off a ton of that toxic waste. If I was working at a club and was tired only a half a can at most would get me moving. It was godawful. I still remember when college kids used to just drink Jolt to stay up.

At this one office I worked at one of the managers was this tall skinny guy he would drink 4 monster energy drinks a day and down a bunch of pills. By 2 pm he was acting like tweek from southpark.

Why should Monster Beverage be responsible for someone abusing their product?

What do you want to bet, she only fed him nutritious meals from McDonald's and Jack in the Box starting around age 2.

You can actually eat marginally healthy at both places if you judiciously chose your menu items and portion sizes. You'll still be high on the salt intake, but nothing that excess water cannot take care of.

But who am I kidding, letting your kid drink 2 of these things a day is asking for a death wish so chances are high she lacked the rational ability to think through actions vs consequences.

Or maybe she was just anticipating this as a payday.

Such delicious sociopathic thinking.  Awesome.

A can of Monster has 160mg of caffeine. A cup of coffee has around 100mg. Drinking 2 cans of Monster a day is like drinking 3-4 cups of coffee a day, which isn't THAT much. If he died from the caffeine, he would have had to have a preexisting condition.

Ok, what's the legal definition of "abuse" here? Look up "contributory negligence" as well.

The caffeine content is around the same as coffee. If I were Starbucks I'd be funding the defence just so that bad precedents aren't set.

It seems like if the Monster Energy drink company can show this kid ate nothing but crap (which I would bet is true), then they can suggest that it wasn't their energy drinks but his poor diet that did him in.

Energy drinks are a huge waste of money. Buy a coffee maker and vitamins if you want that kind of buzz.

Remember Len Bias?  IIRC, he had some rare heart condition when he died while doing cocaine, but all the anti-drug folks used him to say how dangerous cocaine is.

I'm not saying doing cocaine is a good idea, but most people don't die from it.

I've never drank Monster.

I'm drinking coffee right now though - 3rd cup of the day.  Yee-haw!

Hopman: I tried Monster once. It tasted like something off the bottom of a septic truck's oil pan.

The inside or the outside? Because it makes a difference.
I think a dose of hydrocarbon chains would taste better than the foul muck undercoating a septic truck, especially if it had to drive through an overflow. Plus less fecal bacteria.

2013-06-27 10:54:11 AM

Great Janitor: I've had two a day for about six months once.  Had to stop because it tore up my stomach.  I also know people who drink nothing but energy drinks during the day and alcohol at night and I know of no problems with their health.  I think there may have been an unknown health problem that the son had and/or the mother is looking for a payday.

When I was working nights I started drinking two of those a night to stay up. The only problem was when I got of I couldn't sleep so I would end up going back to work tired because of lack of sleep. This led to a nasty cycle. After about a month I completely stopped drinking them and got my sleep pattern right again.

But anyway I'm pretty sure this kid was drinking way more than 2 a day. I have seen people at work drink this stuff like it is water, going through 4 or 5 of them a day.

And another thing about Monster is that it is not only the caffeine content that you have to worry about. It also contains other stimulants that act along with the caffeine.

2013-06-27 10:59:18 AM
Fiance used to drink the orange can and yellow can Monsters. Doesn't anymore, but not for any health reason, just stopped drinking them. (He now opts for Mountain Dew.)

When I worked nights, I would hit Red Bull like a dope fiend. Quit after I had to chase a guy one night and I thought my heart was going to explode. Coincidentally, that same evening I had an epiphany that RB just tasted...terrible.

I would wager that this guy probably had an underlying heart issue, or he was ingesting other "stimulants."

What? It's not good enough for you now? If you don't like it maybe your too young to be drinking caffeine!

"Man up" and stop drinking sugary fizzy drinks. Probably the kind of douche-nozzle who would have grown up to drink alcopops instead of real beer and whiskey.

/No so serious about that
//Don't drink "Energy Drinks", they're not good for you

sboyle1020: I find it hard to believe that someone would die just from consuming 2 energy drink a day.  I'm thinking this kid had an undiagnosed heart condition prior...

Yeah, pretty much... Each energy drink has about a cup's worth of caffeine in it. Maybe two. I wouldn't think it would be enough to kill you.

I would say this... I LOVE green Monsters.

I do not drink them often (obviously), but I REALLY like the taste.

When you read the article, the people who died were mostly teenagers who were drinking way too goddamn much of it.

This. Obviously it's stupid to drink that much of the stuff but I very much doubt that would kill you. It would make you fat and lonely, which would eventually sap your will to live, of course.

I'm sure the 2500 mg of their "energy blend" might have been a bigger issue here... The lethal dose of caffeine is impressive, but chronic doses might have nudged his health a bit...

Buuuut...

Can these people not read? Yes, the kids death is tragic, but if you look at the ingredients on all of these so called energy drinks, you have to be aware how much caffeine and other stimulants are in these drinks... Taking that amount of anything every day is never smart...

People really need to start taking responsibility for their own actions and stop looking to sue someone for being foolish...

Coincidentally:

"L-carnitine is used for conditions of the and vessels including heart-related, (CHF), heart complications of a disease called diphtheria,, leg pain caused by circulation problems (intermittent claudication), and."

I guess they put that in there to balance out the massive dose of caffeine you are ingesting.  :)

Mtn dew has ~5mg per ounce of caffeine.  The high end monster drinks/shots have 80mg per ounce.  That's no adding in the other "energy blend" items.

I'm a big fan of personal responsibility but I don't think most people get how much caffeine and other shiat is stuffed into those drinks.  There should be a point when they move it from the soft drinks section to the medicine aisle.  That said I don't think there is anything out there that says prolong caffeine use/abuse would lead to heart issues.  Everything I have read is about overdose which comes in at a pretty high number.

dookdookdook: Attention Energy Drink Fans:  Caffeine pills are $4 for a bottle of 100 at Walmart.  Paying $2 for a nickel's worth of caffeine mixed into a can of toxic waste and a dash of totally worthless vitamins makes you the very definition of a consumer whore.

Pluiss you can take b vitamins if you want or *gasp* maybe take a multivitamin each day or god forbid eat balanced meals... where will the insanity stop!!!!!

I would be very surprised if the energy drinks are what did this kid in. Energy drinks usually have a lot lower caffeine content than coffee. I wouldn't be surprised if a lot of farkers here drink more caffeine daily than the contents of 2 energy drinks. The rest is just basically soda, and while 32oz of full-sugar soda daily isn't a healthy choice, it isn't going to kill a healthy teenager in only a couple years.

The difference is how caffeine and nicotine is regulated.  Monster may be innocent of this persons death but if their product did have any hand in it maybe a lawsuit will wake people up to the potential dangers.
I don't like the knee jerk reaction to lawsuits that everyone is totally on their own in knowing all the consequences of consuming products available at any store with no age restrictions.
Who sells tobacco and who they sell it to and how they advertise it is very much regulated.  Caffeine not so much.

This is the stuff that finally cured me of my diet dr. pepper habit.

We call it "Mormon meth" in our household. If I drink an entire bottle, I can get a month's worth of software engineering (contract) done in one frightening overnight burst. Then I sleep for two days, and I have the rest of the month free to do other stuff, like fishing with my son or designing random things on ponoko.
