There was nothing "attempted" by Aaron Hernandez. The dude is dead. It was a successful murder. I had no idea the dude was so badass. He played for the Patriots, so I just assumed he was a pussy.

Massachusetts banned it back in the 80's I believe. That said, he's going to spend the rest of his life in jail. I couldn't believe how stupid the reason of the killing was, something about "talking to the wrong person" or "disrespecting" someone. Shrug you shoulder and move on with your $50 million contract, was that and a life of freedom worth your "cred"?

yeah, i think i need more facts to back up the attempted murder theory... article says, he punched a guy who is now in critical condition.

from that set of facts, i find attempted murder to be a real stretch.

*If* the victim dies, you could charge this guy with second degree murder: you attempted to harm - but not kill - the victim but the victim still died. If the victim lives, however, I don't see how there can be *any* attempted murder charge since second degree murder specifically means you weren't trying to kill the victim.

My guess is that the prosecutors are charging this guy under the assumption that the victim dies. And if not, they'll downgrade the charge to assault.

It especially sucks if it was an actual fight where he was defending himself by punching in response to being punched.

If he just swung on the guy without any threat of being physically assaulted by him, then throw the book at him.

I think this is exactly right.  Transferred intent would clearly apply if he died, but the mens rea standard is higher for an attempt crime than the "malice" or similar standard that normally applies to second degree murder.

Murder typically means the intentional killing of another human.  The degrees come into play where special circumstances are involved (i.e. premeditation, murder in the course of committing a felony, etc).  Manslaughter is more typically what you're talking about, where you attempt to harm somebody by battering them, but they unexpectedly die.

Could be different in Ohio.

The crime was committed in New Jersey outside a Gentleman's Club, so Jersey laws apply.  (Not that I know anything about murder laws in New Jersey, or Ohio, or any state for that matter.)
