The American Bar Association - which rates federal judicial nominees as well-qualified, qualified or not qualified - unanimously gave Marquez a qualified rating.

Because they hate the American Bar Association?

Good point.  Republicans have demonstrated that all they care about in judicial nominations is competence.  This is not at all politically motivated.

And if only there was some kind of process to find out why she's not fit to be a federal judge.  Some kind of open forum where peoples' grievances against her could be aired and she could respond.  Something like a ....listening?  No, that's not right.  Damn, the word's on the tip of my tongue ...

We've already seen that play out twice in the last 4.5 years.  After much frothing at the mouth and hand-wringing from the right-wingers, it ends with the justice getting confirmed.

If memory serves, the president generally consults the senior senator from the state with the vacancy during the selection process in order to minimize road blocks.  Did that not happen in this instance?

That would probably cause massive backlash by the voting public. Interfering with circuit court appointees is fine because no one really cares other than politics junkies.

She's an ex-public defender. Less than 10% of federal judges are ex-public defenders. In fact, the "liberal" Obama has nominated more ex-prosecutors (46%) to the judiciary than either Reagan or Bush.

Actually that's the question that need to be put up to McCain (as he's the one who said it and has the power to block a hearing as does Flake). As for making a guess it probably has something to do with her never being a judge or prosecutor before (unlikely) and\or some of the cases that she has participated in in the past. Not enough to sway a hearing but maybe enough to piss off McCain depending upon how she conducted her clients defense and the final outcome (He has come out as being in favor of federal judges having already shown some sort of judicial restraint so that may be it. It was the reason he gave for voting against Sotomayor). Whatever it was, pissing off a sitting US Senator is never a good idea if you have aspirations for a federal office in his state if he\she has a say in it no matter what your political affiliation may be.

I figure that Obama can either try and wait out McCain or submit a different nominee, I highly doubt that there is nobody else as qualified as she is. McCain has certainly allowed and voted for other judges nominated by a democratic president to have a confirmation hearing (he voted for both of Clintons sitting Supreme Court justices (Ginsburg and Breyer for example).

Obviously, but AFAIK, McCain's not a Farker.  BU is.  He stated that she is incapable of being just, so I asked him why.

I wanted to know if he had an actual thought-out answer (whether or not I agree), or whether he was shiatting out partisan BS from his Unicorn ass.  His silence has answered me satisfactorily.

HUGE white trucks (The bigger the better) "OBUMMER" and other hateful bumper stickers  (NRA, Brewer for Prez, NO AMNESTY, etc)  plastered all over the back ends.
Handicapped Placards hanging in every one of them.
Old white men behind the wheel.
Arizona.

So why doesn't he just deal with this using a recess appointment?  In 700 days, I'm pretty sure Congress has recessed at least once.  I would think this should be a non-issue.  Do a timely confirmation hearing or the judge gets seated anyway.  And for confirmations, the hearing is only supposed to be about whether the appointee is qualified or not.  Politics is not supposed to be at issue (yeah, right).

Reid was one of the first to use judicial filibusters in the manner they are currently used.  So really you are acting hypocritical crying now.

At least the GOP, when in control of the Senate was good enough to agree to a Gang of 14 to allow less controversial nominees to pass.  They even did a tit for tat passing Clinton nominees.  Reid and Obama are too ignorant and partisan to ever allow a similar measure to start up again.

So take your soft, whimpering, ignorant cries elsewhere.  KTHNX.
