Considering the fact that there are probably at least a half dozen OTHER photos taken of her while she was standing there with other people's cameras that she has no control over, I think she needs to get over it.

I have no idea what that is referencing (some sort of "Girls Gone WIld" meta reference)?

In anycase, if she is just going after this because she believe's he should have paid her for the photo in his use here, that is one thing (although, definitely not worth $2 mil, but, I guess you start insanely high and settle for $50k or something like that).   But, she comes off as just being "embarrassed" by the photo and by it's usage in this demonstration... which, um, then don't pose in a skimpy swimsuit in public in front of a cutout of Snoop Dogg, if you are worried about those types of things.

This could be the problem... Merely showing the photo? Okay, it's public and not defamatory... on its own. However, if they presented it in an offensive and false light, then they could be liable. The classic example is that a newspaper who takes a picture of a random guy walking through the park and publishes it would not be liable... but if they publish the same picture in connection with a story about rampant drug use and public masturbation by guys in the park, then they probably would be, unless they take sufficient steps to make it clear that they're not implicating the guy or they hide his face.

An old high school acquaintance of mine is now a county sheriff, and works on their internet crime task force.  As part of his job, he goes to many of the area middle schools, lecturing kids on the dangers of social media.  He always checks in on Facebook as to where he is speaking.  So far, I've had him embarrass my two nieces, nephew and my son during his demos.   If they're stupid enough to put embarrassing "open" pics on the internet, that's their own damn fault.

So how did they arrive at the "promiscuous abuser of alcohol(*)" issue? Did her Facebook post include "Here I am with some guy. I want him to break my vajayjay. Oh! I am so drunk! Party!?"

(*) Alcohol has never said 'no' to me. Hence, it cannot be abused. It knew what it was getting in to when it poured itself in to that can and chilled itself to a nice frosty temp.

What a horrible family.  Absent some indication that the presentation actually associated her with promiscuity/alcohol abuse (notably absent in both the girls and the attorneys statements) the whole shiatty family comes across as golddigging coonts.

It sounds like the point of the lecture was to present her as a victim of overly-permissive default 'privacy' settings and an over-trusting cultural attitude toward internet services.
It would be a little incongruous with that concept, to present her as someone who was doing anything *wrong*.

I mean, a lecture on how the internet can turn normal and harmless behavior into a problem doesn't really work so well if you're hammering on the victim's behavior for not being normal and/or harmless.

So either the lecture was pretty farked up, or the case is just for her reality show pitch.
