Am I supposed to be outraged over the violation of the 4th amendment or the pervy cops?

I thought the playing Hey Ya! was particularly inappropriate.

FTFA: The Ledger of Lakeland reports Fetz asked the woman to lift her shirt above her stomach, pull her bra away from her chest and shake it during a May 21 traffic stop.

I don't believe this qualifies as "take off her bra and shake her rack", although that does make for a funnier Fark headline.

Are you all done with the cancer that is the War on Drugs yet?

Just decriminalize and let the Feds compete for sales of their farkin' drugs.

Get the fark back to WORK, not this chit.

This.

It's certainly not as bad as frisking her or patting her down(what many people call groping)

She wasn't forced to actually show ...titillating... anatomy.  So...not pervy.

The only thing she showed was midsection/waistband. And that's common enough for everyone as it is a place weapons and contraband are generally tucked.

Farking bullies. I got pulled over last night leaving work at 1:30am. He said he pulled me over because I swerved (I didn't) but its because I left a bar (I work there.) Already annoyed because he lied about why he pulled me over, I then faced the question "how much have you had to drink tonight?" I said "one beer, at around 6 o'clock." He snapped "I didn't ask you what time it was did I?" I said "oooookay, I'll be exercising my 5th amendment right for the rest of this traffic stop." He said "so you're not going to comply?" I said nothing. He got me out and did the longest sobriety test in history (which I passed) and then wrote me a repair order for a crack in my windshield. Farking bullies.

Everything I know about cops I learned from FARK. I did have one good experience, when I was driving on a suspended license with a head light out and speeding the cop let me off. Now that I think about it... I guess I'm a pretty bad driver.

I get stopped often since I leave a bar late at night. They follow you out. Usually everything is fine and they just check my license. This guy was a dick. Looked like a teenager too. I should have set my phone up or something. It would have been cool to have on video. Even though I was pissed, I drove off patting myself on the back.

You know how people always say that the First Amendment is the most important, so the drafters put it first?  Well, what does that tell you about the 4th, 5th, and 6th, that they put it after the one about not quartering soldiers in our homes, and that obsolete amendment about bear arms.

From the more detailed article in the link:

[Officer Dustin] Fetz stopped Brugger on West Beacon Road as she drove home after picking up Fields from work. He asked the couple for consent to search the vehicle, which Brugger had borrowed from a friend. They adamantly told Fetz he did not have permission to search.

Fetz escorted Brugger behind the vehicle, where he asked her to lift her shirt to and shake out her bra. Brugger didn't want to perform the act, Brown wrote, but she felt threatened and wanted to go home to her newborn child. She didn't sense his request was sexual, but Brown wrote that she "believed he was on a power trip and had it in his mind that they had drugs."

Fetz persisted in asking for consent to search the vehicle.

Brugger then relented, wanting to go home. Then she changed her mind before Fetz could start the search. But he proceeded anyway, searching the vehicle for 10 minutes, even as she shouted for him to stop. Video of the traffic stop shows Fetz popping open the driver door as Brugger and Fields, who followed the officer's orders, sit on the curb.

Officer Jeremy Williams, who arrived at the scene as backup, told the investigator he and Fetz heard Brugger withdraw her consent before Fetz searched the car. Williams told Brown he considered the search improper.

The investigator also wrote that Fetz had said he was completing a "vehicle inventory" to tow and impound the vehicle. But Brown noted Fetz did not have an inventory sheet needed for the search and failed to follow department policy to call for a supervisor's approval to tow the vehicle.

The investigation raised another issue because police dash-cam footage of the stop had no audio. Fetz said he left the audio equipment hanging inside his patrol car, violating LPD policy.

And what's the result of all these policy violations, and potentially unconstitutional searches?

The department placed Fetz, a full-time LPD officer since 2008 with a $48,331-per-year salary, on paid leave for four days in the wake of the state attorney investigation. He returned to work Tuesday.

Well, glad that's been taken care of then.

EvilEgg: Am I supposed to be outraged over the violation of the 4th amendment or the pervy cops?

Neither.

I already demonstrated that it was actually the only non-pervy way to do a search.

Now for legitimizing the search:

1. Headlight out. (the stop was legal)
2. No license. (At this point, a search is legal, you have a charge that you can arrest for)
3. Not her car. (added suspicion)
4. Refused the car search.  Changed her mind and gave permission for car search. Tried to change mind again.  (really suspicious)

Meh, maybe the cop is an asshole(was the passenger even searched?). Doesn't mean he wasn't within the legal confines of his duty.  Doesn't mean she wasn't being over sensitive.

If the vehicle is not down on it's springs from weight of "contraband", it is all a waste of time and merely justification of a padded timecard for the idiot on patrol.
