As a Mexican-American I have to say that I see nothing offensive about that picture.  It's just a silly photo, as far as I'm concerned.

Yes. Clearly. Because no Hispanic owned taco/burrito franchise has ever used the mustachioed sombrero wearing icon to hawk their wares. Ever. It's just not done.
