Have you seen them all? Are you in Telefomin, Papua New Guinea checking to make sure none of the women there are as hot?"

I agre but not for the reasons people think. The idea that Thomas is a "partisan hack" is laughable to anyone who has read his opinions. The partisan on the right of the court is Scalia, and to some degree Roberts.

Thomas is a bad judge because he refuses to judge. He's the anti-judge. For him, judging is simply taking a cookie cutter approach to life's problems and letting other people deal with the consequences. For me, if there is a case against life tenure on the Court it starts with Thomas. He's the type of judge that you get when you combine no accountability with intellectual laziness.

This guy would have never been confirmed in today's political environment. Even back then, when confirmations were pretty routine for SCOTUS judges, he barely got through... amazingly with 11 Dem approvals. There were 57 Dems in the Senate then. What the hell were those 11 thinking?!?!?

By way of comparison, considering the much more highly polarized environment of the last 10 years, Roberts was confirmed 78-22, Alito was confirmed 58-42 Sotomayor was confirmed 68-31 and Kagan was confirmed 63-37.

Thomas? 52-48.  57 Dems in the Senate during that time and he got 52 Yeas. Un-friggin-believable.

/Yea, Alito got 4 Dem votes, but didn't need them

Alito's opinions can be very sharp at times, but in result yes he does lean quite partisan. His views on 1st amendment rights are especially troubling.

ah but note that your comparison is not really apt:

1) When you make a statement regarding attractiveness that is pretty close to being 100% opinion. When you make a statement as regards to dumbest, it may have an element of subjectiveness, but it is still a more concrete assertion.  You dont need to do more than look at a starlet to tell if you think she is attractive.  To actually know if a judge is "dumb" let alone "teh dumbestest", you usually have to explain WHY you think so.

2) you are speaking of a very small group of people.  There have been 112 total so far.

3) Smart is basically the only metric that matters for these guys, and they are, as suggested by their small number and big powers, rather important historical figures.  Thus lots of people HAVE done the research and get tetchy about people who have not running around with what seem like "pull out of ass" statements.

Thus saying your statements and the rebuttals were akin to an argument over who is the most attractive woman out of ~3.3 billion women is, as noted above, strained.

Perhaps a better analogy would be an uninformed Miami denizen stating "DwyaneWade is the best player in the NBA right now!"  near a group of actual basketball fans.  You would expect, given the fact that best player is both stat based and somewhat subjective, and the announcement so strong, that the sports fans would jump in with questions as to the uninformed party's assertion.

When that first speaker responded to questions regarding LeBron, Durant, Kobe and the like with "um nope I don't actually watch basketball, but i have heard people say its Wade" the next step will be a big ol' pile on.

And yet, not a single person said "I offer this candidate as an example of one who is dumber".  They did yell "THAT'S NOT MY JOB", which is true, but those aforementioned basketball fans would certainly be mentioning people they thought were better than Wade.

I don't know if there was at some point a Supreme Court justice dumber than Thomas.  There were plenty back in the 1800s that I don't know anything about.  But considering the gravity of the office, I would be somewhat surprised if there was one who was unambiguously less intelligent than he.  All that said, very few people would argue against the assertion that he's the dumbest in recent memory.  Fewer would come up with a compelling argument against it.

It's not an ethos, it's a total fabrication. The original constitution was almost immediately amended 10 times.

The Federalist society does not WANT the constitution, they want a return to the Articles of Confederation.
