I'm no lawyer, but it might not even be perjury.  Banks pled no contest to rape and the school district settled the lawsuit, so Gibson probably never took the witness stand.   You don't throw someone in jail for a decade just because they're a coont.  They have to have committed an actual crime.

The fact that Banks didn't believe he could get a fair trial was as much to blame for the situation as Gibson.

Civil perjury has a maximum sentence of 4 years in California, is almost never prosecuted, and would probably never succeed here since she recanted her recanting and there's no other proof she was lying.  The main reason the school district won this judgment was that she didn't show up for court.

I didn't say she couldn't be prosecuted, just that she probably wouldn't be and in any case would never get the assloads of prison time everyone's calling for.

I'm betting that she went out and found a shyster who knew there was pretty damn good chance that a settlement would include lawyer's fees, and that the football player kid would be able to get a scrub public defender at best.

And giving the settlement money back to the district wouldn't help, the superintendent would probably just get a bonus or worse a raise like in Beaverton, Oregon. After a special election was held to enact a levy to add teachers he took an $8,000/year raise to $193,000. Unless he's crapping gold bricks, no way he's worth half that. Why couldn't he get by on his $185,000? Was he having trouble feeding his family like Spree?

That's part of what is wrong with education in this country. PAY THE FARKING TEACHERS!! Not the administrators.

What exactly did he do to deserve a raise? Need an additional $15 million from the tax payers to get through the next year?

You can't hire a private attorney to prosecute someone for a crime, that's handled by the county/district attorney.  She didn't sue him in civil court, she sued the district.  So the fact that he could not get a fair trial had nothing to do with who she hired, and everything to do with the locally elected politicians.

False police report in the least, and her parents were in on it too. She needs to be in prison and they need to make laws to protect men from false accusations other than a slap on the wrist or else these will continue. Blah blah blah about women being afraid to come forward if they really are raped...they wouldn't be worried about lying then. If nothing else CPS should deem her an unfit parent and take her litter away.....hit her where it really hurts, then take away her welfare.

Meh, she was only a teenager when this went down.  I'd blame her parents.  They probably made her lie, one way or another, knowingly or not.

Anyway, she's a single other on welfare and can't pay anything back.  (Pretty sad that someone can piss away what could have been a $700k college scholarship, all that money and stupid biatch couldn't buy some birth control).

Women are already afraid or ashamed to come forward in most cases, I don't think being able to go back and put them in prison if it is proved they lied would be anymore of a barrier. I'm not saying the woman goes to jail if the guy is found "not guilty" or a mistrial or anything, but if they had solid evidence of lying (as in the 2 cases I mentioned),

Um, judging by the story (and without knowing more), he managed to convince voters to increase the budget by 4.3% and then took a 4.3% raise.  If a business's CEO oversaw an increase in revenue would you have a problem with his salary being increased by the same amount as the revenue increase?

What happened to Banks is horrible.  But this isn't a widespread epidemic, and the fact that a bunch of men on fark (and, really, all over the place) treat it as such is troubling.

Aside from the high profile cases, I wonder how often this happens that we don't hear about.

There was a case near me a few years back where a girl went to a party and stayed out too late and as an excuse to her parents so she wouldn't get in trouble, she accused 2 other guys of raping her.  They were arrested and for close to a year their names were dragged through the mud before she finally told the truth.  No charges were brought against her and even after she admitted to lying her name still never made the news.

Even though their case never made it to trial they still suffered and you can still find the accusations on the internet and of course they have a record of arrest.  And of course, they were incarcerated for a period of time.
