That's even worse. Just because a cop got his GED, kinda passed a written test, and took some pepper spray to the face doesn't mean you're not allowed to talk with them. You have the right to remain silent, not the mandate.


We obtained official court documents from both sides of this case. On one hand, the arresting officer from the Logan City Police Department, James Adkins, claims that when Jared refused to stop talking, that hindered his ability to do his job, hence, the obstruction charge. On the other side, Ben White points out that nowhere in the arresting officer's petition, does it mention Jared ever making any threats or acting in a violent manner.


That's not obstructing an officer. First off, let the kid go. Second, demote the cop. Third, disbar the prosecutor permanently in all 50 states and blacklist them for every job but food service. You're gonna charge a 14 year old kid with obstruction of justice for TALKING. Seriously? It's one thing if the officer presses for it. One of your most important jobs as a prosecutor is to tell the cops "No. You're not allowed to do this." when they're out of line.

In the absence of reviewing the documents myself (Smoking Gun, anyone) this is bullshiat. Talking is not obstructing an officer, and wearing a t-shirt for the NRA, ACLU, Greenpeace or the CATO Institute or any political advocacy group should not be an issue for any public school without a dress code. This is bullshiat. I used to wear a Bauhaus t-shirt to school with their first album cover on it and no one cared. Hope they demote the officer.

The shirt did not incite or glorify violence.  It merely advocated a Constitutional right and advertised an organization that supports that right.  An image of a gun is just a symbol of the right.

I have no doubt in my mind that the ACLU would be interested in taking this case. It's fresh, it's new, there are other gun-rights oriented groups who I'm sure are eager to stomp this case into the ground, but fail those groups acting, this is the kind of shiat the ACLU loves, and does best.

I wish they were more appreciative of the 2nd amendment, but when shiat crosses into other rights the ACLU takes aim.
