can the restaurant sue her for being inept at walking?

I just don't understand this.  I've walked into a floor to ceiling plate glass window in public before, and it hurt like hell, and all I thought was "boy am I an idiot".

McCarthy dislocated her jaw, broke her nose, tore a rotator cuff and sustained soft tissue injuries to her neck and back

How the shiat can you sustain all those injuries from walking into a window? I tore my rotator cuff once too but I had to get hit by a car to do it.

/also, she sounds fat

How did she enter the restaurant without injury?

FTA: "Essentially there should been some kind of markings on it - a decal, a bar across - something to indicate this was not open space."

You know what might be a pretty good indicator that something wasn't open space? A door attached to it.

She was sprinting to catch the Good Humor truck that passed by.

Normally this tactic is employed by "Shaquina" or such, and involves slipping on ice and suing businesses.

This is a new spin.

"McCarthy dislocated her jaw, broke her nose, tore a rotator cuff and sustained soft tissue injuries to her neck and back, in addition to emotional trauma"

...what? Did the glass panel beat her afterwards?

No it just called her stupid and laughed at her, hence the emotional trauma.

She must have been pretty lacking in the boobies to manage to take her nose and jaw into it that fast. They are called airfunbags for a reason.

Well she must have been rolling towards that window like the boulder chasing Indiana Jones.

The restaurant should put up a sign that says "If you are a stupid farking moron, this is called 'glass.' You cannot walk through it."

To be fair, she was still traumatized by that whole not getting a receipt for her donut thing.

Last time I walked into a glass door/wall it was after talking to a pretty little thing. My head was thinking to much, my brain not enough.

I did that once. It was at about midnight, at the bus station in Mazatlan, MX.
I had to be the only Citizen of the United States for miles, and I was embarrassed and and all I thought was "boy am I an idiot".

Exactly.  My first thought was to look around and see and if anyone was looking, but of course the window was in a steel frame and made a noise that the whole mall heard.  I did get a kick about an hour later when we walked by the store and there was a perfect faceprint on the glass.

Didn't Matthew Perry do that in "A Whole Nine Yards"?

Send her a bill for cleaning the window.

Hard to fake a broken nose & dislocated jaw. I'm with Mugato, she's fatter than all git-out and was probably chasing the Good Humor truck out the door to boot.

2013-06-13 01:45:25 AM
If I could remember the number of times I walked into a window at a restaurant or bar I'd be able to count them but I never sustained any injuries and certainly no emotional distress. I suppose embarrassment if it was recorded but I'd hardly sue over it.

If you can see through the wall, it's a window. Or you're an X-Man.

F=ma

I'm on the "she sounds fat" bandwagon too considering the injuries. Someone of a less massive stature would have probably just kinda bounced off.
That's not the issue, though. The issue is that she's an idiot and of course that's someone else's fault.

That's the first thing I thought of. I was going to find a pic of that but I was too lazy to GIS it. So here's a pic from the same movie.

This could set a great precedent; If all goes well,  soon you can crash your car into an Appleby's and sue them for building the restaurant in the wrong place.

2013-06-13 01:53:37 AM
The restaurant my wife manages has a glass front wall. People walk into it all the time.  Maybe they should get some kind of idiot insurance or something, in case this woman shows up.

I'm guessing she doesn't live above the first floor in her housing complex, or have a house with a second story or else any time she is upstairs she's risking severe bodily harm from being an idiot and having windows.

2013-06-13 01:56:32 AM
thanks Obamacare! this poor woman has to sue because she can't afford insurance to cover her stupidity.

2013-06-13 01:56:35 AM
The part that really screams scam artist is the claim of "soft tissue injuries to her neck and back ."  A claim that can not be proved or disproved medically, but is chronic, requiring years of treatment (read, really big settlement).

I have seen 6 or 7 adults walk into glass objects of one kind or another and they have all been girls has anyone ever seen a guy walk into a wall is it just bad luck or is it related to the female inability to park inside the lines.

All I can think of is that she grabbed the tip jar and ran blindly.  We've seen that sort of thing on Fark.

Bwahahahahahahahahaha!  I hope she stands up in front of a judge and he laughs at her and then dismisses the case.

Also, Culver's sucks rancid donkey balls.

Also, people who live in glass houses shouldn't walk through doorways.

I got a concussion running into a metal awning outside the Burger Barn next to my airport. I mean, it's at 6 feet, of course people are going to bang their head on it.

I did it just once, in high school. The only thing I was thinking was "oh god I hope nobody saw me do that".
