You signed a contract. STFU and stop signing contracts without reading them. Asking what he's going to do with the photos has nothing to do with whether he'll decide to do something other than he mentions in the future. You signed a full release like a dumbass and then expected him to use the photos only as you wish without adding stipulations into the contract. FAIL.

promotional items ≠ merchandise

Reading the contract doesnt really help if the other party does not follow the contract. If they were handing out those pillows for free I could see siding with the vendor here.

Your point that these people were being naive is valid, but many people probably wouldn't even think something like this was a possibility until there had been reported incidents of it. Still, if someone wants to use an image of you and doesn't specify the context, it's probably safer to assume that a fetish or porn context is a possibility.

While there is a responsibility to read what you're signing away, the contract is not exactly ironclad.  The language of "promotional items" is really vague, and I would not shed a single tear if this guy was buried under a mountain of litigation and finds that he can never work with any cosplayer ever again because he's torched his bridges.

If you need to run your business with vague contracts, then your business sucks.

This.  Hire a lawyer to draw up your own terms and carry copies with you.  Be prepared  to sign your own release.

Putting their likeness on merchandise that you are then selling to the public is not promotional.

Yes. But this is fark where we randomly pick a side and defend it no matter how much information we have or subsequent facts.

So I'm going with the photographer, and everyone who disagrees is arbitrarily a dumb newb.

But yeah, regardless of the contract, I agree that he's stupid to burn his bridges that way. The cosplay world does not forgive. Have a lot of friends into it and they are very vindictive individuals. If he pissed off a few, they all hate him.
