There was actually a supreme court ruling a couple years ago(I forget the name of the case) but the short version is that they can't come onto your property and then use the smell of marijuana as probable cause for a search. So it would be illegal for them to come knock on your front door for no reason (or so they have an excuse for a search) and then say "I could smell mary jane through the door so I searched the residence and found a three year old joint under the couch." If you're in an apartment and they smell it from the common areas of the building or if you've got clouds of smoke rolling out your windows then this ruling isn't going to help you. Likewise a search of your person on the street or your vehicle is a different ballgame.

.....aaaaaaand there's your problem.  Call me cynical, but any legal theory that depends on 100% honesty and decency of cops is not much of a theory.  More of a hope.  Amazing how cops can develop magic noses when they need it.

First off, you shouldn't drive baked. Doing so defeats the argument that pot smokers are otherwise law abiding and responsible.

Secondly, FTA : police say they regularly intercept suspected burglars and thieves by stopping their vehicles on traffic violations, then invoking stench of pot to initiate a search, according to probable cause affidavits. In many of the Boca cases, the search leads to the recovery of glass-breaking window punches, stolen credit and debit cards, and other stolen items

You shouldn't get baked while driving away from a heist. Go home, empty the car, and then be farking stupid.

I thought it went like this, if I'm reading the 4th amendment correctly:

probable cause -> get search warrant -> execute search warrant

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. "

Of course I do they become obsessed with the drug. It starts to take over their lives. It's a psychological dependency you smoke it to relax, to be inspired or funny. But it really makes you slow witted and boring. All you talk about is the government and weed and the only people who really care about this is you.
I don't care I have seen people become so dense because of the drug that they think it's a good idea to cook or drive while high. I have seen classmates grades slip and drop out. Then they wonder why no one takes them seriously about pot use.
I never want to see this stuff legal for just those reasons. Go ahead call me a troll but a pothead may have caused the deaths of innocent people in the collapse of that building in Philly.

MY BROTHER DIED AFTER OVERDOSING ON MARIJUANA
He was invited by the "cool kids" to hang out at some kids house whose liberal parents had left for the weekend.

My brother, always a moral and thoughtful individual, wanted to attend because it was one of those massive house parties that he'd never been to.

Well, as was later recalled by some of his friends at the party, he was pressured into smoking marijuana. He ended up smoking the entire pack of marijuana cigarettes.

Not long after he went into convulsions and started foaming at the mouth. The people at the party held back calling 9/11 for almost 10 minutes.

When the paramedics finally arrived they could do nothing to save him.

The autopsy revealed he had 3 times the lethal dosage of blood in his THC.

But I'm sure everyone here will deny my story and the fact that my brother died after smoking that illegal narcotic.

You've never known a person who HAD to wake and bake? HAD to smoke to unwind? HAD to smoke everyday?

This person is addicted to pot. You can argue that pot doesn't augment body chemistry like alcoholism, but needing to smoke pot in order to live life is addiction.
