Hmmm. $5k was the deductible, meaning there was insurance available. I'd have been tempted to fight for a bigger payday, not just for the money but also to stick a thumb in the eye of the buffoons involved.

Blanchard said the officer who arrested Freeman "did the right thing under the conditions he had," but the decision was made not to take the case further.

Which is why the city paid out $5,000 in damages and had the charges against Freeman dismissed. Because they "did the right thing." Folks, this is what is known as a "contradiction."

You've got to go back several links in TFA.

Local douchebag 'libertarian' refuses to pay property taxes for years.  Has his property seized & gets evicted.
Local douchebag 'reporter' and other local douchebags create a ruckus at the property auction.
Before the next auction, the town puts up notices saying 'no videotaping' because they expect the local douchebags to create another ruckus, and want to prevent them from fulfilling their attention whore desires.
Local douchebag 'reporter' goes ahead and videotapes, and the case is eventually settled in his favor.

Occasionally auctions are dirty.  For instance where item's are recorded as sold at an auction which were never up for bid. (A dirty inside sale).  An old boys network pulling that kind of scam wouldn't want anyone recording the auction on tape.

It sounds to me like they are lucky he's willing to settle for $5,000, because I suspect if he pushed and wen to court, they would spend more than that on the lawyer bills, plus end up paying him a lot more.

Way more.

Sounds like they tried to arbitrarily enact prior restraint in a public venue... and that's clearly illegal.

They got off cheap for pulling a rights-grabbing action, then persecuting someone for exercising those rights. No wonder the aclu got involved.

Freeman cited the Glik decision to demonstrate his right to videotape. Simon Glik was arrested after videotaping Boston police officers with his cell phone

What kind of tape did he use in his cell phone? Beta? VHS? Quad? DVC?


Just to cover this again:

 "A  videotape is a recording of images and sounds on to magnetic tape as opposed to film stock used in filmmaking, or random access digital media."

Say "language changes" all you want. It doesn't change the definitions. Saying he videotaped something with his cell phone is like saying he burned an MP3 with his micro cassette recorder.

That helps, actuallly.

Yeah, gonna side with the reporter, barely.  Government agencies need to accept the reality that they are on candid camera, and getting a "no recording" order should be like "innocent until proven guilty."  "No recording devices" should require a damn good reason before it can be enforced.

Sure, they'd raise a ruckus, but then you'd actually have an excuse to arrest them that WOULDN'T cost you 5000 dollars and result in no charges.

I think it's funny that the guy who refuses to pay taxes makes his living as a fire fighter.  Those taxes that other people pay are why he has a salary, but he doesn't think he should have to pay the same bills.
