That was just the example sentence from the dictionary.  Anybody who gets caught up in the legal system and doesn't get prosecuted or convicted could be counted as "walking".  Like suspects who are taken into the station but don't get arrested.  Cop shows say "Let him walk" all the time after they've interviewed a suspect they can't arrest.

Yeah, but given the high profile of the case and the number of  people killed, why would they let him walk at that point?

Not sure why you are moving the goal posts.  First you say technicality then you say it is because the cops can't arrest him.

I thought he was already arrested?

There has been no trial yet and the prosecution is still pulling together it's case.
