How in the hell is this place still open?  Gotta just be stunt diners at this point, the "it can't possibly be THAT bad"  or "let's see if we can get kicked out of there, before it's gone" crowd.

The rumor is that it's laundering money for other activities.

No actual evidence, of course, but I gotta say that would make sense.

Wait a minute, wait a minute, wait stop right there! Listen: Stop right there, man.

A man goes into a Amy's Baking Company. You listenin'? A man goes into Amy's Baking Company, and he sits down, he's having a bowl of soup and he says to the waiter, waiter come taste the soup.
Waiter says: Is something wrong with the soup?
He says: Taste the soup.
He says: Is there something wrong with the soup? Is the soup too hot?
He says: Will you taste the soup?
What's wrong, is the soup too cold?
Will you just taste the soup?!
Alright, I'll taste the soup - where's the spoon??

Back when I worked as a restaurant drone, we were encouraged to come up with ridiculous responses to fly-in-drink/soup complaints. It was sort of a competition to see who could think of the funniest and cleverest ideas. Some of the stock responses were straight out of vaudeville, but we had a few originals. The way it worked is that the server for the table would yell to whatever other server was nearby, and that server would yell back the response.

Customer: Waiter! There's a fly in my drink!
Waiter: Jeff! There's a fly in this customer's drink!
Other Waiter: Shhhh. If other people find out, everybody will want one!

Customer: Waiter! There's a fly in my drink!
Waiter: Jeff! There's a fly in this customer's drink!
Other Waiter: I know. Took me ten minutes to catch the little bugger, brush him with egg yolk wash, roll him in tempura batter and fry him up.

Customer: Waiter! There's a fly in my drink!
Waiter: Jeff! There's a fly in this customer's drink!
Other Waiter (looking down at the glass): Drinking on the job, eh? That's the third time this week. You're fired, mister- and this time I MEAN it!

Customer: Waiter! There's a fly in my drink!
Waiter: Jeff! There's a fly in this customer's drink!
Other Waiter: Well, we tried using chickens, but frankly they were just too big.

Customer: Waiter! There's a fly in my soup!
Waiter: Jeff! There's a fly in this customer's soup!
Other Waiter: (coming over to look in bowl) Shhhh. Leon? Leon! Is that you!??? Oh my god- somebody call an ambulance! What am I going to tell his wife- and his poor children! Oh Leon, why couldn't you be more careful? (carries soup bowl back to kitchen, sobbing hysterically)

There were dozens of other "stock" responses. One of my favorites was a variation of the "Leon" routine where ALL of the other waiters and waitresses would come over and pretend to be distraught at the sight of "poor Leon" drowning. We always did loud and over-the-top campy. The customers got a laugh out of it, and it diffused an otherwise unpleasant confrontation. And of course, the offending drink/soup/whatever was always whisked back to the kitchen and replaced with a fresh one.

because the drinks are part of the experience, and if they can't even get that right (three times) and get flustered and kick you out for asking...

then it's not your fault for not wanting bugs in your drink, that you are paying for.

Even if true, you'd think they'd make an effort to keep business brisk, lest authorities notice that this place with tumbleweeds blowing through it seems to be generating huge revenue. Or you could be right and they're as incompetent in washing money as they are in serving food.

Not to mention that Samy admitted, on camera, that he takes his servers tips, which is a direct violation of the FLSA.

From the FLSA regarding tipped employees: The employer is prohibited from using an employee's tips for any reason other than as a credit against its minimum wage obligation to the employee ("tip credit") or in furtherance of a valid tip pool.

Hope he enjoys having the US Department of Labor pouring over his books as the DOL takes the FLSA very seriously.

Also from the FLSA:

Retention of Tips: A tip is the sole property of the tipped employee regardless of whether the employer takes a tip credit. The FLSA prohibits any arrangement between the employer and the tipped employee whereby any part of the tip received becomes the property of the employer. For example, even where a tipped employee receives at least $7.25 per hour in wages directly from the employer, the employee may not be required to turn over his or her tips to the employer.

I would expect that she might eventually her nemesis as a customer would would take it to city hall and raise hell, because she would take it from "bullies".

2013-05-26 05:36:23 PM
Thanks to Fark and Reddit I watched that episode last night.  It was the only episode of that show I have ever seen.  There were a laundry list of problems.  First, I order and it takes an hour for my food and as I leave, before my food arrives, and the restaurant stops me and demands that I pay for food never received, I will let them call the cops and press charges for false arrest and then sue the owners for said false arrest.  Amy should stick to just baking cakes.  She can't handle a full restaurant.  She needs a simple bakery.  Samy can not manage.  He needed to let the servers do their jobs, not do have their jobs and then blame them when he messes up the orders.

Amy and Samy are in for a huge world of legal problems now.  If they decided to pay their servers like real servers, no one will tip because they don't believe the servers will get their money.  Hell, I would imagine that Samy would keep half the tips because he is still doing part of their jobs.  Undercooked meat is a health code violation.  People who are looking just to sue business owners would be targeting that restaurant due to the poor quality of the food, and/or the lies on the menu (such as fresh food that is store bought and frozen).  Not to mention the lawyers who saw that episode and may have contacted the employees, past and present for a class action lawsuit.

Biggest question: how did that place ever make a profit?  I honestly can't imagine anyone paying for food there, going back twice, or getting their food right the first time.

Great Janitor: Biggest question: how did that place ever make a profit?  I honestly can't imagine anyone paying for food there, going back twice, or getting their food right the first time.

Even sadder is the Yelp reviews, starting all the way back with the first negative review.  They outright accuse him of being from a rival restaurant sabotaging them, and almost every bad review after until just around the airing of the episode comes with an amendment stating they were being harrassed by the owners of ABC, demanding images of receipts to prove they weren't fake reviews, insisting they out themselves, or flatly denying that they ever entered the restaurant. (Like they can really remember every damn face that enters)  Right from the start they bully the naysayers and try to discredit them, it's surreal, even the Pyro in TF2 doesn't have such a warped sense of reality.

And it is rather clear after the show and all the reviews that the 5-star ratings are the ones that are more than likely fake as hell.  Wouldn't be surprised if it was revealed that all the 5-star ratings were former employees being kowtowed into posting a great review by the wannabe mob-boss.
