Why does Congress even bother to pass an act they already know will be thrown out on it's ear by the US Supreme Court as a 1st Amendment violation?

It's alreadya crime to lie about something like this for material gain.  The fraud statues take care of that nicely.  So this ONLY criminalizes what amounts to "talking smack" in a bar or on TV, and that, while sad and pathetic, IS protected as free speech.

I have no problem criminalizing it if someone's trying to make a financial profit from it, but I gotta wonder what "the intent to profit personally" means. Boastful lying could just be an attempt to make yourself look better to impress a girl/guy. One could consider that "profiting personally." I'm guessing that's not what was intended, though.

An earlier version was (properly) overturned.  If this one is limited to lying for financial gain then I'm pretty sure it's under the rubric of fraud and not protected speech.  It's still your constitutional right to pick up chicks by lying.

Exactly. In terms of use of the medals for benefits, that's already covered under fraud. Don't get me wrong, I love busting these guys. Partially on moral terms, but a lot of it is watching them squirm when they can't answer questions they should know. You know, questions like "where'd you go to Basic Training" or "what's your MOS/Rate/AFSC" "when were you in" etc.

Am I reading this right? SCOTUS ruled that lying is protected by the 1st Amendment, but how about those cases where the government can't pin someone for committing the crime, but get them for "lying to investigators"? The case of Martha Stewart comes to mind.

I propose that instead of these people being put in jail they be allowed to be free to say whatever they want. On the other hand if caught by someone who actually served where they are saying or actually won the award they are claiming kicks their ass the punishment is limited to a fine of one dollar US.
