Actually, I have some insight on this matter, as my mom is good friends with a family whose son is currently serving time in a prison in Florida for being an 18 year old boy who was woken up and received oral sex from a 15 year friend of his while he crashed on their couch, and was stupid enough to admit that it happened when questioned about it by her father, a sheriff.

I'm actually kind of hoping this story generates enough outrage that he may be able to himself released for being the poster boy of the exact opposite situation.

Oh, and in his case, he's mentally deficient by four or five years, so it's not even entirely clear he realized it was illegal.

I have a friend with a 16 y.o. son whose 14 y.o. girlfriend asked her to buy plan b.  Things are definitely different than when I was in high school.  Some 'children' are making some pretty adult decisions these days.

Jury nullification.

I got removed from jury duty because I admitted that I believe in jury nullification as a method of checks and balances against the government making bullshiat laws.

Still...its statutory rape.  THIS law happens to be a good one.  It punishes adults who have sex with kids....like what this girl did.

I don't think this is a florida thing. I don't believe that any state has the age of consent at 14.

Ironically, if he hadn't been arrested, he was probably going to die because his family was struggling to afford his leukemia medicine, and his body was starting to reject his donated kidney.  He's a whole mess of medical and health problem, and now he's getting better healthcare in prison than his family could afford on the outside.  Lemons to lemonade I guess.

Another article I read on this on msnbc said they started dating at age 17 / 14, but didn't have sex until age 18 / 15.

That's bullshiat and you now it. Do you remember being 14? They know exactly what they're doing. I agree that the gay thing isn't a factor but 15 years? For a couple months on the calendar? People get less than that for armed robbery or manslaughter.

Ya, uh...statutory rape cases can be unfair sometimes, but this isn't one of those times. 14 is too young, and an 18 year old should be keenly aware that they're a legal adult on their 18th birthday. Anyway, the law should apply equally to all regardless of sexual orientation (all laws).

Average age for losing virginity is between 16 and 17, so the reality is that high school students are likely screwing.  As a parent, rather than fight a losing battle against hormones, I just encouraged monogamy with other students who had plans to go off to college and such.  That way their partner also has a vested interested in not becoming a parent before graduation and with the monogamy STD issues can hopefully be avoided.  Right now there does seem to a be a divide though, many other parents thought the same way, to the point where the father of my son's girlfriend mentioned to me he and his wife were fairly certain their daughter had an interest in being sexually active, so they'd gotten her on the pill and there was no need to worry.  Other parents though just went totally off the deep end in the other direction, either because they were convinced God would smite the shiat out of you for screwing or if you screwed your future was instantly over because you'd become some sexual deviant.

It always seemed odd to me, high school is the time where I as a parent can overtly or covertly influence partner selection and also be around to handle any complications, be they medical or a Plan B run.  I'd rather my kid make a mistake or two while I'm there to bail them out than have them make the mistakes in college where I'm 12 hours away.

/never had to make the Plan B luckily

There's a big difference between 18 and 14. If it was a 15 year old with a 14 year old I would have a lot more sympathy for her. But in this instance, she deserves some jail.

Ah.  I thought that it was, or that there was one of those 'romeo and juliet' laws in place.  Whatever.  The law should apply to gay and straight alike.  That's what equality looks like.

Hey, I think it's entirely reasonable to make it illegal for an 18 year old to sleep with a 14 year old - the degree of punishment, however, is up for discussion. And it sounds like the 18 year old here is getting a sweetheart of a deal if she's exempt from registering as a sex offender and can avoid being adjudicated guilty.

Aren't the parents of the 14-year old holy rollers who conspired with police to get the older woman busted once she turned 18 rather than deal with the situation privately? It takes a pretty elevated level of self-righteous certitude to drag your under-aged daughter through this kind of traumatic experience. I wouldn't be at all surprised if the 14-year old sues for emancipation from her parents, who are probably lining up a 'pray-the-gay-away' boot camp.
When the older of the two was 17 it was legal, but the relationship carried on past her birthday so it is now a felony?
The intent of the law is to address the acts of sexualpredators, not to stop young classmates from having sex, which is completely different.

Some states have have laws though where the age of consent is 16, but 16 and 14 is not illegal, these are known as close age exceptions.  The big problem is that 18 on 14 doesn't really sound like a candidate for close age exception, but society still puts them in the same peer group (especially at smaller high schools where there is more interaction).  It gets weird of course, because you have the following problems:

14 and in 8th grade, with an 18 year old (so not in the same school):  Not cool.  Downright creepy at best.
14 and in 9th grade, with an 18 year old (in the same school):  Shady, strikes of senior guy sleeping with naive freshman girl, but does it warrant sexual offender charges?
15 and 17:  Not a problem
15 and 18:  Illegal unless there is a close age exception. (What if the couple started at 15 and 17, but one person just had their 18th birthday and it is still a few months until the other turns 16?)

Basically I don't have an issue with age of consent, but the close age exception could be done better.

It would be better if it listed months differential vs years.  So if 17.11 and 15.9 is legal, 18 and 15.10 is still good instead of suddenly illegal.
